Adopted. CITY MANAGER CoMMUNICATIQNS Regular Meeting 2 Alameda Ca.ty Council ~'uly 7, 2009 ~~9r } State Budget Update The Deputy City Manager provided an update. Mayor Johnson inquired whether an interest rate has been set on IoU's, to which the Deputy City Manager responded the interest rate has been set at 3.750. Mayor Johnson inquired whether the $26.3 billion [Stated deflclt is the amount at the end of the current fiscal year. The Deputy City Manager responded the $26.3 billion deficit covers an eighteen-month period. Councilmember Gilmore stated the League of California Cities has been successful in lobbying not to have property taxes taken away; inquired whether anything is fair game now, to which .the Deputy City Manager responded in the affirmative. Coun.cilmember Tam stated that she attended the League of California Cities Policy Committee Meeting; ten mayors from the largest cities in California sent a letter to the Governor stating that they would prefer the State to consider borrowing instead of straight takeaways, such as the qas tax. The Deputy City Manager stated taking gas tax money would be a problem; the property tax money would be borrowed because of Proposition 1A. vice Mayor deHaan stated the State's bond rating is BBB; two more steps down would be considered junk bonds. Council.member Gilmore inquired whether there has been any talk regarding some cities potentially going bankrupt. The Deputy City Manager responded that she has not heard anything; stated a lot of cities have passed a Resolution of Hardship. vice Mayor deHaan stated the matter is extremely concerning, particularly with unemployment hitting record highs. Councilmember Matarrese stated revenue projections need to be addressed; going with prior year plus growth cannot be done anymore; that he is disturbed that five people in the State are running the show. Councilmember Tam stated Alameda is heavily dependant on property Regular Meeting ~ Alameda City Council duly 7, 20x9 taxes; 900 of State income tax revenue comes from the top 10% income earners; the League of California Cities, California State Association of Counties, and School Board associations are meeting at a summit on July l8; the City is invited to participate. In response to Mayor's Johnson's request for an update on the County lifting up the bridges, the Public Works Director stated the County will need to review bridge operations if the gas tax is taken away; the County is compensated by the State for the Harbor Bay Isle Bridge and is compensated by the federal government for the Railroad bridge; the other three bridges are the County's responsibility; the County uses the gas tax to operate the other three bridges; the bridges would need to be left in the up position without the gas tax; the County Public Works Director initially indicated that the bridges would be up at all times, but then stated that the bridges would be up during off~peak hours; at a recent meeting with County officials, Mayor Johnson advised that keeping the bridges in the open position would be unacceptable; the City gave some Measure B money to the County for bridge operation; the County receives approximately $900,000 per year for bridge operation which could have gone to the City for special projects. Councilmember Matarrese inquired whether Council authorized allocating said funds for the operation of the bridges; questioned whether the City Engineer would have been authorized to negotiate. the matter. The Public Works Director responded that he does not know; further stated the County Public Works Director drafted a letter requesting that the Army Corps of Engineers consider allowing the bridges to remain down during the late evening and early morning hours; the County thinks that a decision could take twelve months; the federal government would need to approve the requested change in operations; stated Mayor Johnson sent a letter stating that traffic congestion and emergency services would be significantly impacted and could not be mitigated; the County's attorneys are reviewing the matter. Mayor Johnson stated the Harbor Bay Isle Bridge does not have a bridge tender during the middle of the night; one commercial business needs to have the estuary bridged open; the federal government could save a lot of money by allowing less than twenty- four hour bridge tenders; that she made it very clear that the br.zdges are the County's responsibility and the City cannot help with additional funding. Councilmember Gilmore inquired whether the County acknowledged receiving $900,000 in dedicated funding for bridge operations. Regular Meting 4 Alameda City Council July 7, 2009 The Public Works Director responded in the negative; stated everyone specified projects to fund when Measure B was reauthorized; a decision was made by an Alameda County Transportation Authority ~ACTA7 Policy Advisory Committee and projects were selected; the County is contending that the greater County agree that fU.nding bridge maintenance is important and that the City did not provide any funding; there is no documentation to prove either way. Vice Mayor deHaan inquired what is the Coast Guard's role in controlling commerce activity during the late hours. The Public Works Director responded the Coast Guard has a very big voice which is why the County Public Works Director sent a letter; the County is trying to make the point that there are not many calls for bridges to be open in the late evening and early morning hours; the aggregate company had seven late hour bridge openings in May. Vice Mayor deHaan stated the Coast Guard was brought into the discussion in 1994; the matter needs to be revisited. Mayor Johnson stated the Coast Guard dogs not have a lot of discretion regarding waterway access; changes are needed in federal legislation; that she does not have the impression that the County pursued all issues; the County believes one option is to have Alameda pay for part of bridge maintenance and operation; the County does not have detailed information on maintenance and operation costs. Councilmember Gilmore inquired whether Oakland is being asked to participate in bridge maintenance and operation costs. Mayor Johnson stated said issue was pointed out at the meeting. The Public Works Director stated the County feels that the bridges only serve Alameda. Councilmember Tam stated the County recently adopted a budget with significant cuts; the County is still assuming the gas tax funding will be received from the State. Councilmember Matarrese inquired whether the current County budget includes operators and bridge tenders, to which the Public Works Director responded in the affirmative. Mayor Johnson stated the County receives a significant amount of Regulax Meeting 5 Alameda City Council July 7, ~Q09 money from the City; Alameda does not receive a lot of direct services from the County; people need to know how much of Alameda's property taxes go to the County; inquired whether specific information can be provided. AGENDA ITEMS ~09~- } Public Hearing to Consider Resolution No. 14351, "Amending Master Fee Resolution No. 12191 to Revise Fees." Adopted. The Interim Finance Director gage a brief presentation. Vice Mayor deHaan inquired what is the Consumer Price Index CPI}. The Interim Finance Director responded the CPI for the San Francisco Bay area is 0.8%; stated the Eng~neerirzg .dews .Record's Construction Cost Index is 6.30; different indexes are used for different fees. In response to Mayor Johnson's inquiry, the Interim Finance Director stated the Recreation and Park Department fees are recommended by the Recreation and Park Commission; Affordable Housing Unit fees were not increased because of current economic conditions; ambulance fees are based upon th.e County's fee schedule. Mayor Johnson inquired whether permit f ees would be affected, to which the Interim Finance Director responded in the affirmative. Mayor Johnson inquired whether permit fees will be reviewed as a whole at some point; stated some fees loak reasonable if isolated, but problematic when combined with other fees required for a project. Vice Mayor deHaan stated activity becomes more concerning than anything else; staffing will be determined by fee generation once the Planning and Building Department has its own funding. The Assistant City Manager stated the City will need to be more nimble than in the past; larger projects tend to subsidize smaller projects; more money is spent on staff effort than what is received in fees; fees may need to be raised for smaller items. Mayor Johnson stated staff is spending an unjustifiable amount of time on small projects; staff cannot go overboard on small projects . In anticipation of Pisces service,. the City contracted with CLE Engineering, Inc. ~CLE} in the fall of 200 to conduct a marine survey to determine the depth of the HarborBay FHB}Channel. DISCUSSION The marine survey identified two shallow areas near the entrance to the ferry terminal that currently restrict the operation of the Pisces to tidal conditions above one foot, Since this restriction reduces the ability of WETA boats to operate in the regular vessel rotation or to provide needed backup service, WETA and City staff agreed that maintenance dredging of the channel was needed, and that WETA would fund the project. On January 00, 2009, the City entered into an agreement with CLE to prepare the plans and specifications, acquire all permits, and prepare the necessary documents forthe dredging work. A copyafthe plans and specifications is on file in the City Clerk's office. Over the years, the City has repaired the damaged infrastructure by removing the concrete sidewalk, trimming or shaving the tree roots causing the uplift, and replacing the concrete sidewalk However, as the trees grow, the roots may continue to raise the sidewalk. The Public ~lorks Department is in the process of updating the City's Master Tree Plan, which includes a selection of fine species that are appropriate for the City's specific site constraints, including narrow planter strips. The City Council's approval of the plan is anticipated this fall, The City contracts for the permanent repair of sidewalks, curbs, gutters, and driveway approaches on an annual basis. Locations for repair are identified by resident calls and an annual inspection program. High pedestrian use areas are inspected annually, and the remainder of the city is divided into five zones, with a zone being examined every five years. Temporary repairs, asphalt fillets, or grinding are typically completed within 30 days by the Public U1lorks Department Maintenance Division. Section 1, Item No, 20, of the Cooperative Agreement requires the City to operate, maintain, and manage, at the City's cost, the modified bike path, including those portions located within the existing State Highway System right-of-way. The City, through a previous Encroachment Permit with Caltrans, already is responsible for the maintenance of the existing bike path. DISCUSSIQN The Maintenance Agreement for the bike path has been prepared by Caltrans and reviewed by the City Attorney, and is acceptable to the Public Works Department, A copy of the Maintenance Agreement is on file in the City Clerk's office. Each .Board requires the preparation of a Sewer System Management Plan SSMP}, which the Public Works Department has prepared as an element of the City's Sewer Master Plan. As part of the SWRCB requirements, the governing body of a collection system agency is required to accept the completed SSMP. The SWRCB schedule requires that the SSMP be completed by August 2, 2009. DISCUSSION As shown in the table below, the City has completed all ofthe necessary tasks required by the SWRCB. DISCUSSION The City of Alameda labor relations representatives have met in closed session with the City Council to discuss negatia~ions with the ACEA~ The revised MCU is a result of those negotiations and falls within the parameters authorized by the City Council. In a spirit of effective and responsible cooperation, the membership of the ACEA has approved this agreement, which does not include any wage increases during the two- year term. The MOU does include same minor language modifications, revises the compensatory time benefit, and extends the current health benefits through the term of the MOU. FINANCIAL IMPACT The cost for implementation of the health and welfare benefit adjustments for FY09~10 is approximately $141,OG9 of which approximately $33,G00 is the cost to the General Fund. This cost is included in the FY09~10 budget as a projected benefit increase. The cost for implementation of health benefit adjustments for FY10111 is approximately $1Da;972 of which approximately $3G,058 is the cost to the General Fund. On April 27, 2009, the Planning Soard recommended approval of the proposed map A map of the location of the property, as well as the Planning Soard staff: report, and resolution are included with this report as Attachments 1-3. DISCUSSION The, Planning hoard considered the Tract Map on April 27, 2009 The proposed tract map reconfigures the existing parcel lines at Alameda Towne Centre The change in parcel lines does not change the allowable amount or intensity of development at the shopping center. The amount and intensity of development permuted is regulated by the Planned DevelopmentAmendment ~PDA} for the center. FINANCIAL IMPACT No City funds are required. The applicant, in accordance with the City's adopted tee schedule, pays the costs associated with processing this application PUBLIC NOTIFICATION A notice for this hearing was mailed to over S75 property owners and residents within 500 feet of this site and interested parties who have previously requested notification, published in the Alameda Journal and posted at the subject property. Staff has not received any public comments on this project as of July ~ , 2009. ENVIRONMENTAL REVIEW Pursuant to the CEQA Guidelines, Sectian 15162 -Subsequent Environmental Impact Reports, the future expansian of Alameda Towne Centre was considered in the Environmental Impact Report for the Planned Development Amendment. The proposed subdivisian is consistent with the approved entitlements for the site. Honorable Mayor and Members of the City Council from: Ann Marie Gallant Interim City Manager Date: July 21, 2009 Re~ Hold a Public Hearing to Consider a Planning hoard Recommendation to Abandon the Proposal to establish New Zoning Provisions to Limit the Height and Size of Two-Story Residential Buildings for Properties Located on the 3200 black of San Jose Avenue, Adams Street, and Washington Street DACKGRC~UND In 2007, a group of 47 property owners in the vicinity of Fernside boulevard and Washington Street submitted a petition to the City Council asking the City to consider imposing more restrictive limitations on building height, floor area and the location of second stories in their neighborhood. After the City Council directed staff to evaluate the proposal, staff held two community meetings to gather input from the residents At the meetings, community support for imposing additional zoning restrictions on these properties was mixed, and the residents on Madison Street submitted a new petition requesting that their street be removed from the proposed zoning district. 4n April 27, 2009, the Planning Board held a public hearing at which most of the speakers spoke in opposition to changing the zoning regulations for these properties. After hearing from the public and considering the various options presented by staff, the Planning board unanimously recommended that the City Council not change the zoning limitations on building height, floor area and the location of second stories zoning standards in the neighborhood. The Planning Board also directed staff to amend the Citywide Design Guidelines to incorporate some of the design guidelines that were developed for the rezoning proposals to assist in future design review applications. DISCUSSIGN In 200?', concerned residents submitted a petition to the City Council requesting the Council to direct Planning and building staff to design an ordinance that would ensure that specific sections of the City of Alameda Guide to Residential Design would be enforced. To accomplish this, the petition specifically requested that maximum allowable building height be reduced from 30 feet to 20 feet, allowable second story floor area be limited to X00 square feet, and that second stories be limited to the rear half of the house. Among the attendees there was little consensus concerning the need for additional regulations or the approach that should be taken if new regulations were to be imposed on the neighborhood. Specifically o The majority of all residents agreed that the original proposal submitted by the petitioners, which would have made the construction of second stories infeasible in most cases, was overly restrictive. The majority of residents did not want an outright ban on two-story buildings. ® Many residents agreed that some of the two-story homes approved in the neighborhood were not well designed. ® Although seven out of the 21 households on Madison Street signed the original petition, at the community meeting residents of Madison submitted a petition signed by over 90 percent of the property owners requesting that their block be removed from the proposed zoning overlay district. As shown in the map below, the removal of the Madison Street properties leaves only 63 properties the shaded blocks} within the area that would be affected by the revised regulations. within the current study area of 03 properties excluding Madison Street}, there are seven two-story dwellings and two vacant lots that are large enough to support new single-family residential development. An application is pending that requests approval of a new two-story home on one of these two lots. There are six existing two-story houses an the south side of Madison Street which, although no longer in the proposed overlay district, would abut the rear yards of properties within the overlay district. The area will continue to see reinvestment and improvements as property owners expand their homes or build homes on the few remaining vacant parcels, and the City should encourage and support reinvestment in the community. The concerns articulated by the original proponents of the rezoning are design problems that should be resolved through improvements to the design review process, not changes to the zoning regulations whereas the City of Alameda's Design Review Manual provides extensive guidance regarding additions to Craftsman and Victorian homes, the manual does not provide detailed guidance on how to design an addition on a "mid century" or "ranch-era" home. Given these conclusions, the Planning Eoard recommended that the City Council: . Reject the proposal to change the zoning regulations for the 63 properties. 2, Direct staff to develop amendments to the Design Review Manual to improve the design review process for "mid century" or "ranch-era" homes. ~n the second recommendation, the Planning Board made a point of stating that the amendments to the Design Review Manual should be considered within the overall Planning & building Department's work program and prioritized as appropriate given all of the other important initiatives on the program. The Board also acknowledged that the draft guidelines already prepared were a very good start, and not a lot of additional work would be needed to incorporate these guidelines into the manual. A copy of the draft "City of Alameda Ranch Zoning Overlay Design Guidelines" is Attachment 1. FINANCIAL IMPACT There is no financial impact from denying the rezoning request. The funds for amending the Design Review Manual would be allocated from the Planning and Building Department's Community Planning Fee account. MUNICIPALCODEIPCLICYDCCUMENTCRC~S REFERENCE The Municipal Code requires that the City Council make specific findings to approve a zoning amendment: 1}that the amendment maintains the integrity of the General Plan; 2} that the amendment is in the best interests of the community and supports the general welfare of the community; and 3} that the amendment is equitable. The Planning Board was not able to make the necessary findings to recommend the zoning amendments. Pursuant to CEQA Guidelines Section 15054 and 15305, the proposed changes to existing development standards would not have the potential to cause significant adverse environmental effects and are exempt from environmental review. Rejecting the proposed zoning overlay would represent a continuation of the existing regulation and would not be considered a "project" under CEQA. RECGMMENDATIGN 1.
