AUTHORIZING THE INTERIM CITY MANAGER TO ENTER INTO A
MAINTENANCE AGREEMENT BETWEEN THE CITY OF ALAMEDA AND
THE STATE OF CALIFORNIA DEPARTMENT OF TRANSPORTATION FOR
THE MAINTAINENANCE OF THE BICYCLE PATH AT THE FOOT OF THE
NORTH SIDE OF THE BAY FARM ISLAND BICYCLE BRIDGE
WHEREAS, the City is proposing to realign the existing bike path at the foot
of the north end of the Bay Farm Island bicycle bridge; and
WHEREAS, City of Alameda Resolution No. 14291 authorized the City
Manager to enter into a Cooperative Agreement with the State of California
Department of Transportation (Caltrans); and
WHEREAS, the Cooperative Agreement No. 4 -2123 was executed on
February 13, 2009; and
WHEREAS, Section 1, Item 20, of the Cooperative Agreement requires that
the City operate, maintain and manage, at City's cost, the bike path, including those
portions located within the existing State Highway System (SHS) right -of -way.
NOW, THEREFOR, BE IT RESOLVED that the Interim City Manager is
hereby authorized to enter into and execute such maintenance agreement in a form
that is acceptable to the City Attorney's Office.
I, the undersigned, hereby certify that the foregoing Resolution was duly and
regularly adopted and passed by the Council of the City of Alameda during the Regular
Meeting of the City Council on the 21st day of July, 2009, by the following vote to wit:
AYES: Councilmembers deHaan, Gilmore, Matarrese,
and Mayor Johnson - 4.
NOES: None.
ABSENT: Councilmember Tam -
ABSTENTIONS: None.
