Mayor /Chair Johnson convened the meeting at 5:15 p.m.
Roll Call - Present: Councilmembers /Commissioners deHaan, Gilmore, Matarrese,
Tam and Mayor /Chair Johnson — 5.
Absent: None.
The meeting was adjourned to Closed Session to consider:
(10 -271 CC) Conference with Legal Counsel — Anticipated Litigation; Significant
exposure to litigation pursuant to subdivision (b) of Section 54956.9; Number of cases:
One.
(10 -272 CC) Public Employee Performance Evaluation (54957); Title: City Attorney.
(10 -273 CC) Conference with Legal Counsel — Anticipated Litigation; Significant
exposure to litigation pursuant to subdivision (b) of Section 54956.9; Number of cases:
One.
Following the Closed Session, the meeting was reconvened and Mayor /Chair Johnson
announced that regarding Anticipated Litigation [paragraph no. 10 -2711, Council
received a briefing from its Legal Counsel; no action was taken; regarding City Attorney,
Council directed the City Attorney to bring back her goals and objectives by the second
meeting in September, 2010; no action was taken; and regarding Anticipated Litigation
[paragraph no. 10 -2731, Council received a briefing from Legal Counsel regarding a
matter of potential litigation; no action was taken.
Mayor /Chair Johnson called a recess at 7:30 p.m. and reconvened the meeting at 1:30
a. m. * **
The meeting was adjourned to Closed Session to consider:
(10 -274 CC) Conference with Legal Counsel — Anticipated Litigation; Initiation of
litigation pursuant to subdivision (c) of Section 54956.9; Number of cases: One.
(10 -275 CC/10 -42 CIC) Conference with Real Property Negotiator; Property: 1590 and
1616 Fortmann Way; Negotiating Parties: Warmington Homes, City of Alameda and
CIC; Under Negotiations: Price and terms.

Following the Closed Session, Mayor /Chair Johnson announced that regarding
Anticipated Litigation, Council received a briefing on a matter of anticipated litigation
and provided direction to Legal Counsel; and regarding Real Property, the Council and
Commission received a briefing from its real property negotiator regarding potential sale
of City -owned property to Warmington Homes.
Adjournment
There being no further business, Mayor /Chair Johnson adjourned the meeting at 2:10
a. m.
