AN ORDINANCE AUTHORIZING
THE ACQUISITION OF CERTAIN
REAL PROPERTY FOR STREET
AND HIGHWAY PURPOSES.
WHEREAS,
public interest and
necessity require that the real prop-
erty hereinafter described be ac-
quired by the City of Alameda for
street and highway and general
municipal purposes; and
WHEREAS, Guido Spadoni is the
owner of the real property here-
inafter described and is willing to
sell the same to the City of Ala-
meda for the sum of $2,304.00;
BE IT ORDAINED BY THE
COUNCIL OF THE CITY OF ALA -
MEDA:
Section 1. That the City of Ala -
rneda purchase from Guido Spadoni,
for the sum of Two Thousand, Three
Hundred Four ($2,304.00) Dollars,
that certain real property situated
in the City of Alameda, California,
more particularly described as fol-
lows:
PORTION of the parcel of
land described in the deed by
Emanuel Danton to Guido Spa-
doni, dated April 29, 1922, re-
corded June 20, 1922, in book 219
of Official Records of Alameda
County, at page 262; and a por-
tion of parcel of land described
in the deed by Gino Spadoni to
Guido Spadoni dated March 24,
1938, recorded March 25, 1938, . in
book 3623 of Official Records of
Alameda County, at page 96,
described as follows:
BEGINNING at a point on the
western line of said secondly
above mentioned parcel of land,
distant thereon south 1° 25' west
67.61 feet from the southern line
of Pacific Avenue; and running
thence along said western line
south 1° 25' west 30.29 feet to
the southwestern line of said
parcel of land; thence along the
last named line and the exten-
sion thereof southeasterly on a
curve to the right with a radius
of 2311.88 feet, a distance of
43.54 feet, more or less, to the
eastern line of said first above
mentioned parcel of land; thence
along the 1L, =t named line north
1° 25' east 28.47 feet to a point
distant thereon south 1 25' west
85.53 feet from said line of
Pacific Avenue; and thence
north 64° 58' 38" west in a
direct line 44.74 feet to the point
of beginning,
on the following terms and condi-
tions:
(a) That good and merchantable
title in fee simple in said real prop-
erty be conveyed to the City of
Alameda, free and clear of all objec-
tions, liens and encumbrances, but
subject to second installment of
taxes and assessments for the fiscal
year 1948 -1949;
(b) That the title to said real
property be evidenced by a policy of
title insurance issued by Alameda
County -East Bay Title Insurance
Company, insuring title in the City,
as provided in the preceding sub-
division;
(c) That upon deposit with said
title company for delivery to the
City of a good and sufficient deed
of grant conveying said property to
the City, and conditioned upon the
issuance of a title insurance policy
as aforesaid, to be approved by the
City Attorney, a warrant of the
City to be drawn for Two Thou-
sand, Three Hundred Four ($2,304.00)
Dollars, payable to the order of
said Guido Spadoni, and delivered
to said Alameda County -Past 'Bay
Title Insurance Company, as escrow
holder, for the purpose of effecting
the consummation of said purchase.
Section 2. The sum of Two Thou-
sand, Three Hundred Thirty -seven
($2,337.00) Dollars is hereby appro-
Driated from Gas Tax No. 2 Fund
to pay the purchase price of said
real property and cost of title in-
surance policy.
Section 3. This ordinance shall be
in full force and effect from and
after the expiration of thirty (30)
days from the date of its final pas-
sage.

that the foregoing Ordinance was

passed by the Council of the City
of Alameda in regular meeting as-
sembled on the 18th day of January,
1949, by the following vote, to wit:
AYES: Councilmen Anderson,
Jones, Osborn, Sweeney and Presi-
dent Branscheid, (5).
NOES: None.
ABSENT: None.
