AN ORDINANCE AMENDING SEC -
TION 15 -524 OF TITLE X V, CHAP-
TER 5, ARTICLE 2.: OF :THE
ALAN EDA MUNICIPAL. .
RELATING T O DOGS THAT BITE.
BE IT ORDAINED BY THE COUN-
CIL: OF THE CITY OF ALAMEDA:
Section 1. That Section 15 -524 of
Title XV, Chapter 5, Article 2, of
the Alameda Municipal .Code be; and
the same is hereby, amended to read
as follows:
Section .15 -524. _ Dnty of Cus-
todian of Dog Which Has Bit-
ten Any Person.
(a) Whenever it is shown that
any dog has bitten any person,
the owner or person having the
custody or possession thereof
shall, upon order of the Health
Officer, deliver said dog to the
Poundmaster who shall quar-
antine it and keep it tied up or
confined for a period of two
weeks, -and the :Health Officer
may make an _inspection or ex-
amination thereof at any time
during said period. If it shall
appear to the "Health' Officer,
upon examination as aforesaid,
or otherwise, that a doh;, has
rabies, he may kill it forthwith.
(b) If, during the said: period
of two weeks, the Health Offi-
cer shall determine that said
dog is °.vicious and dangerous
to human beings and; in. his
judgment, should be killed,. he
shall notify the Poundmaster of
such determination. It shall then
be the dtity of the Poundmaster
to kill said :vicious dog within
ten (1 -0) days after .receiving
the notice- of the IIea;lth Of-
ficer' determination. If the
.Health Officer shall determine
that such dog is:n'ot vicious but
has a propensity to bite human
beings, said dog shall be released
by the Pouudmaster to the own-
er or person having the cus-
tody -or possession thereof, but

no such dog taken into custody
and released. in accordance with
the foregoing; provisions of this
section' shall be permitted to
run at large in any of the public
lanes, alleys, streets or other
public places in the City of Ala-
meda unless such dog is secure -
ly muzzled. Any owner or per -
son, having the custody . or pos-
session : of any such dog who
allows or permits such dog to
run at large in the City of
Alameda in violation of the
foregoing - provisions of this
section shall be deemed guilty
of a misdemeanor.
(c) Any dog that bites a
human being more than once
upon any of the public lames,
alleys, ,street,-, or public places
in the City of Alameda shall be
presumed to be . vicious.
Section 2. This ordinance shall be
in full force and effect from and
after the expiration of thirty (30)
days from. the date of its final
Passage.
