SEAWALL EASEMENTS AND AU-
THORIZING THE EXECUTION OF
QUITCLAIM DEEDS TO MANUEL
SOARES AND MINNIE. SOARES
HIS WIFE, WILLIAM SILVA ANB
VIRGINIA SILVA, HIS WIFE, AND
ANNA C. SILVA.
WHEREAS, by a certain indenture
from Manuel Soares and Minnie Soares,
his wife, and William. Silva and Vir-
ginia Silva, his wife, to the City of
Alameda, a municipal corporation,
dated the 16th day of Match, 1949, and
recorded in the office of the County
Recorder of the County of Alameda,
State of California, on April 6, 1949,
in Book 5768 of Official Records, at
page 465, said Manuel Soares and
Minnie Soares, his wife, and William
Silva and Virginia Silva, his wife,
granted to said -City of Alameda a
certain easement and right of way to
establish, construct, reconstruct, re-
pair and maintain a levee, .:mlkhead or
seawall in, through, on and along that
certain parcel of land situated in the
City of Alameda, County of Alarneda,
State of California, bounded and de-
scribed as follows:
PARCEL 1:
A twenty (20) foot Arip of land
on each side of the following de-
scribed center line:
BEGINNING at a point distant
52.80 feet which bears North 73'
East from Station No. 95, a; such
Station is shown and delineatcd
upon that certain map entitled
"Sales Map No. 10" of Salt Marsh
and Tide Lands, as recorded m.
Book 3 of Maps, Page 471, and filed
June 9, 1388, in the office of the
County Recorder of Alarrieda
County, California; thence running
North 73 East 178.20 feet, to a
point; thence North 54' 45' East
448.80 feet to a point; thence North
84 30' East 250.80 feet to a point;
thence North .89* 30' East 92.02 feet
to a point; thence South 70' East
439.56 feet to a point; thence North
145.20 feet to a point; thence North
21' 30' East 190.74 feet to a point,
which point is the Northeast
corner of property belonging to
Manuel Soares and Minnie Soares,
his wife, and William Silva and
Virginia Silva, his wife, all in
Section 30, Township 2 South,
Range 3 West, Mount Diablo Base
and Meridian;
and
WHEREAS, by a certain indenture
from Anna C. Silva to the City of
Alarneda, a municipal corporation,
dated the 16th day of March, 1949, and
recorded in the office of the County
Recorder of the County of Alameda,
State of California, on April 6, 1949, in
Book 5768 of Official Records, at page
468, said Anna C. Silva granted to
said City of Alameda a certain ease-
ment and right of way to establish,
construct, reconstruct, repair and main-
tain a levee, bulkhead or seawall in,
through, on and along that certain
parcel .of land situated in the City of
Alameda, County of Alameda, State
of California, bounded and described
as follows:
PARCEL 2:
A twenty-foot (20-ft.) strip of
land on each side of the following
described center line:
BEGINNING at a point distant
11748 feet which bears North 42'
45' West from Station No. 96 as
such Station is shown and delin-
eated upon that certain map en-
titled "Sales Map No. 10" of Salt
Marsh and Tide Lands, as recorded
in Book 3 of Maps, Page 471, and
filed June 9, 1888, in the office of
the County Recorder of Alameda
County, California; thence running
South 42' 45' East 117.48 feet to
Station No. 96; thence South 51'
East 229.02 feet to a point; thence
North 73' East 52.80 feet to a point,
which point is the Southeast corner
of property belonging to Anna C.
Silva, all in Section 30, Township
2 South, Range 3 West, Mount
Diablo Base and Meridian',
and
WHEREAS, it is no longer neces-
sary for the City of Alameda to retain
said easements and rights of way above
referred to and it appears to this
Council that said easements and rights
of way are not and will not be required.
by the City of Alameda for the purpose
of establishing, constructing, recon.-
StrUcting, repairing and maintaining a
levee, bulkhead or seawall in, through,
on and along those certain parcels of
land hercinabove described, or for
any other purposes whatsoever;
NOW THEREFORE, BE IT OR-
DAINED BY THE COUNCIL OF THE
CITY OF ALAMEDA:
Section 1. That the said easements
above referred to, granted to the City
of Alameda by each of the indentures
referred to in the preamble hereof, be,
and each of the same is hereby, aban-
doned and vacated.
Section 2. That the Mayor of the
City of Alameda be, and he is hereby,
authorized and directed to execute,
and the City Clerk to attest, as the
act and deed of the City of Alameda,
a quitclaim deed remising, releasing
and quitclaiming to Manuel Soares
and Minnie Soares, his wife, and
William Silva and Virginia Silva, his
wife, all of said k City's right, title and
interest in and to the easement and
right of way described or referred to
in the preamble hereof as Parcel 1.
Section 3. That the Mayor of the
City of Alameda be, and be is hereby,
authorized and directed to execute,
and the City Clerk to attest, as the
act and deed of the City of Alameda,
a quitclaim deed remising, releasing
and quitclaiming to Anna C. Silva all
of said City's. right, title and interest
in and to the easement and right of
way described or referred to in the
preamble hereof as Parcel 2,
Section 4, This ordinance shall be
in full force and effect from and after
the expiration of thirty (30) days from
the date of its final passage.
