AN ORDINANCE VACATING A
SEWER EASEMENT OVER CERTAIN
LANDS AND AUTHORIZING EXE-
CUTION OF A QUITCLAIM DEED
TO THE UNITED STATES OF
AMERICA.
WHEREAS, heretofore the City of
Alameda acquired an easement for
sewer purposes over and upon the
lands hereinafter particularly de-
scribed; and
WHEREAS, it is no longer necessary
for the City of Alameda to retain the
ca,gernent over said lands hereinafter
described and it appears to this Council
that said easement is not now and will
not be required by the City of Alameda
for sewer purposes or for any other
purposes whatsoever;
NOW THEREFORE, BE IT OR-
DAINED BY THE COUNCIL OF THE
CITY OF ALAMEDA:
SECTION 1. That the easement for
sewer purposes in, over and upon that
certain land situated in the City of
Alameda, County of Alameda, State of
Califoinia, particularly described as
follows :
'Beginning at the point of intersection
of the Northern line of Pacific Avenue
with the Eastern line of Third Street;
running thence South 88 degrees 09
minutes 30 seconds E along the said
line of Pacific Avenue 3,00 feet to a
concrete monument set at an angle
point in said Northern line of Pacific
Avenue; thence continuing along said
line of Pacific. Avenue South 88 degrees
37 minutes E 606.02 feet to a point
which is 21.30 feet westerly along the
north line. of Pacific Avenue from the
southeast corner of that certain parcel
of land deeded from the United States
of America to the Alameda Mutual
Homes Corporation and recorded in
Book 5459, page 313, and also recorded
in Book 5738, page 560, of the Alameda
County Recorder's office; then N 1
degree 41 minutes 02 seconds E 251.64
feet to the TRUE POINT OF BEGIN-
NING: thence along the northerly line
of aforesaid property of the Alameda
Mutual Homes Corporation N 88 de-
grees 09 minutes 30 seconds W 3.66 feet;
thence N I degree 21 minutes E 493.36
feet to a point in the north property
line of Brush Street extended, as said
line is described in the deed from
United States of America to Alameda
Unified School District which is re-
corded in Book 5745, page 487, of the
Alameda County Recorder's office;
thence along said north property line
of Brush Street extended S 88 degrees
09 minutes 30 seconds E 6.54 feet;
thence S I degree 41 minutes 02 seconds
W 40.35 feet to the true point of be-
ginning, be, and the same is hereby,
abandoned and vacated.
SECTION 2. That the Mayor of the
City of Alameda be, and he is hereby,
authorized and directed to execute, and
the City Clerk to attest, as the act and
deed of the City of Alameda, a quit-
claim deed remising, releasing and
quitclaiming to the United States of
America acting by and through the
Housing and Home Finance Agency,
Public Housing Administration, all of
said City's right, title and interest in
and to the easement described in Sec-
tion 1 hereof.
SECTION 3. This ordinance shall be
in full force and effect from and after
the expiration of thirty (30) days from
the date of its final passage.

Council of the City of Alameda in regu-
lar meeting assembled on the 19th day
of June, 1951, by the following vote,
to-wit
AYES: Councilmen Anderson, Bran-
scheid, Jones, Sweeney and President
Osborn, (5).
NOES: None,
ABSENT: None.
