AN ORDINANCE AUTHORIZING THE
ACQUISITION OF CERTAIN REAL
PROPERTY FOR STREET, -HIGH-
WAY AND GENERAL MUNICIPAL
PUHPOSES.
WHEREAS, public interest and
necessity require that the real prop-
erty hereinafter described be acquired
by the City of Alameda for street and
highway and general municipal pur-
poses• and
WHEREAS, T. HOWEN, also known
as THOMAS HOWEN, and EMMA S.
HOWEN, his wife, are the owners
of the real property hereinafter de-
scribed and are willing to sell the
same to the City of Alameda for the
sum of $3,750,00.
BE IT ORDAINED BY THE COUN-
CIL OF THE CITY OF ALAMEDA:
SECTION 1. That the City of Ala-
meda purchase from T. HOWEN, also
known as THOMAS HOWEN, and
EMMA S. HOWEN, his wife, for the
sum of Three Thousand Seven Hun-
dred Fifty Dollars ($3,750.00), that cer-
tain, real property situated in the City
of Alameda, California, more particu-
larly described as follows:
All that lot of land situated in
the City of Alameda, County of
Alameda, State of California, de-
scribed as follows, to-wit:
BEGINNING at a point on the
southwestern line of Encinal Ave-
nue, as said avenue now exists,
distant thereon south 49' east 890
feet from the southeastern line
of Post Street, as said Street is
shown on the "Map of the Hirsch-
- field Tract, Alameda," filed April
27, 1889 in Book 11 of Maps, page
73, in the office of the County
Recorder of Alameda County (the
bearing of said line of Encinal
Avenue being taken as south 49®
east for the purpose of this descrip-
tion); and running thence along
said line of Encinal Avenue and
the direct Pxtension thereof south
49' east 70.57 feet to the north-
western line of Lot 31 in Section
18 Township 2 South, Range 3
West, Mount Diablo Base and
Meridian; thence along the last
named line south 58' 30' west 89.79
feet to the direct extension south-
easterly of the southwestern line
of Lot 43, as said lot is shown on
the "Map of the survey of 4 acre
lots made by J. E. Whitcher in
Alameda," filed March 9, 1863 in
Book 5 of Maps, page 7, in the
office of the County Recorder of
Alameda County; thence along the
direct extension of the southwest-
ern line of said Lot 43 north 49*
west 45 feet, more or less, to a
line drawn southwesterly from the
point of beginning, parallel with
said. line of Post Street; thence
along said last drawn line north-
easterly 85.67 feet to the point -of
beginning,
on the following terms and conditions:
(a) That good and merchantable title
in fee simple in said .real property be
conveyed to the City of Alameda, free
and clear of all objections, liens and
encumbrance,9; City and County taxes
to be prorated as of date of closing of
this sale.
(b) That the title of said real prop-
cx be evidenced by a policy of title
insurance issued by Alameda County-
East Bay Title Insurance Company,
insuring title in the City, as provided
in the preceding sub-division.
(c) That upon deposit with said title
company for delivery to the City of a
good and sufficient deed of grant
conveying said property to the City,
and conditioned upon the issuance
of a title insurance policy as aforesaid,
to be approved by the City Attor-
ney, a warrant of the City be drawn
for Three Thousand Eight Hundred
($3,800.00) Dollars, payable to the
order of and delivered to said Ala-
meda County-East Day Title Insurance
Company, as escrow holder, for the
purpose of effecting the consumma-
tion of said purchase and payment of
title insurance.
SECTION 2. The sum of Three Thou-
sand Eight Hundred ($3,800-00) Dollars
is hereby appropriated from Gas Tax
No. 2 Fund to pay the purchase price
of said real property arid cost of title
insurance policy.
SECTION 3. This ordinance shall be
in full force and effect from and after
the expiration of thirty (30) days from
the date of its final passage,
