AN ORDINANCE AMENDING
ARTICLE 4, CHAPTER 5, TITLE II
OF , THE ALAMEDA MUNICIPAL
CODE BY AMENDING SECTIONS
2-541, 2 -542 AND 2 -543 THEREOF
AND ADDING THERETO NEW
SECTIONS TO BE KNOWN :.AS
SECTIONS. 2-547 AND 2 -548, RELAT-
ING TO VACATIONS.

CIL OF THE CI`T'Y . OF ALAMEDA:
SECTION 1. That Section 2 -541 of
Article. 4; . Chapter 5, Title II, of the
Alameda Municipal Code is hereby
amended to read as follows:.

All.::officials and employees in the
continuous and regular eixaployzxment .of
the City, whose compensation is fixed
on .a monthly basis; and who shall
have been in the service of the City
for not less than one (1) year, and
all employees employed on a per diem
basis who have .been employed by
the City for at least 225 days during
the twelve- rnontb period immediately
preceding the commencement of the
vacation . shall be allowed
In each calendar year, a vacation
with . pay of ten (10) regularly sched-
uled:working drays annually, computed
on the basis of a five -day work week,
In cases of employees worlfing snore
thin a five-day work week vacation
thi e shall be fourteen (14) calendar
days,
If a holiday, other than Saturday,
Sunday or : Faster Sunday, occurs
within the vacation period of said
employee; he shall receive an extra
day vacation for such holiday.
SECTION 2. That Section 2 -542 of
Article 4, Chapter 5, Title 11 of the
Alameda' Municipal Code. is hereby .
amended to read.as follows:
Section. 2 -542. Computing Time of
Employment. In computing such time
of employment, credit shall be given
for all tune such .official or employee
was absent from duty on sick leave,
under the provisions of Article. 3 of
this Chapter, and for leave of absence,
not : excee :rung thirty days, while he
was in active service in the State
Militia ' or in the military or naval
service of the United States. The
words "two weeks" shall mean the
number of working days an employee
would ordinarily work in a normal
two -week period. A "normal two - week
period" shall mean a two -week period
in . which . there occurs no ' holiday,
SECTION 3. That Section 2 -543 of
Article 4, Chapter 5, Title II of the
Alameda Municipal Code is hereby
amended to read as follows:
Section 2 -543. Vacation on Termi-
nation of Employ'ixmeni. In the event .
that any such official or employee.
shall leave the service of the City; if
he be then entitled to a vacation under
the foregoing provisions; he shall be
paid for the vacation period to which
he was then entitled, provided, how-

ever, that in the : ease of an official
or employee who shall have been dis-
missed from the service ol: the :City;
it : shall be within the discretion of
the head of :the department in which
he was eirnpl )yed, or of the Board. or
other official body. having power of
appoimitment or a e,°mioval, to determine
whether, under the cireurnstances sir' -
rounding . such dish i.ssal, such official
or employee shall receive pay for : any
vacation period to which, but for such
disnii.is al, he then would have been
entitled.
In the ease of any official or em-
ployee whose service is terminated by
his death, such payment shall be;..made
to the person legally entitled thereto.
SECTION 4; The Alanmeda Municipal
Code is hereby amended by adding to
Article 4., .Chapter 5, Title Il new
sections to be known as Sections 2 -547
and 2 -548, which said sections shall
read as follows:
Section 2 -547. 111s4p- in Immediate
Family. whenever any officer or em-
ployee is compelled, to be absent from
duty by reason of death, or critical
illness where death . appe ars to be im-
minent, of . either father, mother,
brother,. sister husband, wife, or child,
such officer or employee shall receive
compensation during such absence at
the regular rate of pay for time neces-
sary to be absent, from work; neat, how -
ever, to exceed three (3) working days
in. all; provided that the compensa-
tion herein provided to be paid shall
be paid only when the officer or ent-
ployee absent shall furnish satisfac-
tory evidence of the facts justifying
such absence,
Section 2.548. Military Leaves of Ab-
sence. Every officer and employee shall
be entitled to such leaves of absence
with pay - and other benefits as are
provided by Division 2, Fart 1, Chap-
ter .7; Paragraph .395, of the Military
and Veterans Cade of the State of
California:
SECTION 5, This ordinance shall be
in full force and effect from and after
the expiration of thirty (30) days from
the date of its final passage,
