AMENDING ARTICLE 6, CHAPTER 2,
TITLE V. OF THE ALAMEDA MU-
NICIPAL CODE BY ADDING
THERETO A NEW SECTION TO BE
NUMBERED 5-264.1 RELATING TO
SIDEWALK OBSTRUCTIONS.
BE IT ORDAINED BY THE COUN-
CIL OF THE CITY OF ALAMEDA as
follows:
Section 1. The Alameda Municipal
Code is hereby amended by adding to
Article 6, Chapter 2, Title V, a new
section numbered 5-264.1, which shall
read as follows:
See, 5-264,1 Exceptions. The provi-
sions of Section 5-264 shall not apply to
(a) Hydrants, lamp posts, telegraph,
telephone and power poles erected or
to be erected by permission of the City
of Alameda or the Board of Public
Utilities of said City.
(b) Street trees planted along the
outer line of sidewalks within the
curb line and barriers for the protec-
tion of such trees.
(c) Bicycle racks in place or here-
after placed upon the sidewalks by
permission of the Chief of Police and
of the adjoining property owners for
the accommodation of persons using
such bicycles. Such racks shall not
exceed three (3) feet in width and
three (3) feet in height and shall be
entirely devoid of advertising matter.
(d) Benches presently in place and
which may, by permission of the City
Council, hereafter be placed within
the curb line at bus stops throughout
the City.
(e) Newspaper racks presently in
place and which may hereafter be
placed within the curb line by per-
mission of the City Council; such racks
shall be secured in such manner as
to prevent their being. blown about
or falling upon the sidewalk.
Section 2. This ordinance is hereby
declared to be a measure of great
emergency and necessity for the im-
mediate preservation of the public
health and safety and shall take effect
immediately. The following is a state-
ment of the facts showing the urgency:
There are now some obstructions
unlawfully in the sidewalk areas of
the City of Alameda and it is the aim
and purpose of this ordinance to legal-
ize such obstructions and to confer
express legislative authority upon the
City Council to permit similar obstruc-
tions hereafter.
