AN ORDINANCE AUTHORIZING
THE ACQUISITION OF CERTAIN
REAL PROPERTY FOR STREET
AND HIGHWAY PURPOSES.
WHEREAS, public interest and neces-
sity require that the real property
hereinafter described be acquired by
the City of Alameda for street and
highway and general municipal pur-
poses; and
WHEREAS, Alameda Unified School
District, a public body, is the owner
of the real property hereinafter de-
scribed and is willing to sell the same
to the City of Alameda for the sum
of $8,000.00;
BE IT ORDAINED BY THE COUN-
CIL OF THE CITY OF ALAMEDA :
Section 1. That the City of Alameda
purchase from Alameda Unified School
District, a public body, for the sum of
$8,000.00, that certain real property
situated in the City of Alameda, Coun-
ty of Alameda, State of California,
more particularly described as follows:
A portion of Lot 13 in Section 10,
Township 2 South, :Range 4 West,
Mount Diablo Base and Meridian,
as said lot is shown on "Map No. 2
of Salt Marsh and 'fide Lands,
situate in the County of Alameda,
State of California," bounded as
follows:
Beginning at the point of inter-
section of the center line of Third
Street (60.00 feet wide) produced
southerly with the southwestern
line of Central Avenue, formerly
Main Street (55.00 feet wide), pro-
duced southeasterly, as said streets
are shown on the Map entitled,
"Bayview Tract," filed Tune 29,
1922 in Book 7 of Maps, page 33,
in the office of the County Re-
corder of Alameda County; run-
ning thence along the said line of
Third Street produced, south 3° 07'
15" west (the bearing south 3 07'
15" west being assumed for the
purpose of this description) 29.26
feet; thence north 55° 34' 54" west
126.00 feet, more or less, to a point
on the eastern boundary line of
said Lot 13; said last mentioned
point being the actual point of
commencement; thence continuing
north 55° 34' 54" west 542.25 feet,
more or less, to a point distant
north 55 34' 54" west 668.25 feet
from the most southern extremity
of that certain course designated
as "South 3° 07' 15" west 29.26
feet" herein mentioned; thence
northwesterly along the are of a
curve to the right with a radius
of 726.34 feet, tangent to the last
mentioned course, a distance of
272.34 feet to the intersection there-
of with the western line of said
Lot 13; thence north 1 32' 15" east
along the said last mentioned line,
43.79 feet to the northeastern line
of said Lot 13; thence along the
said last mentioned line, south 50
27' 45" east 1.41 feet, more or tcs
to a. point on the southwestern
line of said Central Avenue (55.00
feet wide); thence southeaste1y
along the said last mentioned. `line,
824.78 feet, more or less, to a point
on the said eastern boundary line
of Lot 13; thence southerly along
the said last mentioned line, 29,77
feet, more or less, to the actual
point of commencement,
on the following teri s and conditions:
(a) That good and merchantable title
in fee simple in said real property be
conveyed to the City of Alameda, free
and clear of all objections, liens and
encumbrances.
(b) That the title to said real prop..
erty be evidenced by a policy of title
insurance issued by Alameda County -
East .Bay Title Insurance Company, a
corporation, insuring title in the City,
as provided in the preceding subdivi-
sion, said title insurance to be at the
expense of the City of Alameda.
(c) That upon deposit with said title
company for delivery to the City of a
good and sufficient deed of grant con -
veying said property to the City and
conditioned upon the issuance of a title
insurance policy, as aforesaid, to be
approved by the City Attorney, a war-
rant of the City be drawn for X8,000.00,
payable to the order of and delivered
to said Alameda County -East Bay Title
Insurance Company, a corporation, as
escrow holder, for the purpose of
effecting the consummation of said
purchase.
Section 2. The sum of $5,100.00 is
hereby appropriated from Gas Tax No.
2 fund to pay the purchase price of
said real property, cost of title insur-
ance policy, and other expenses.
Section 3. This ordinance shall be in
full force and effect from and after
the expiration of thirty (30) days from
the date of its final passage.
