Ordinance 1128Ordinance No. 1128 New Series AN ORDINANCE AUTHORIZING AC- QUISITION Or CERTAIN. REAL PROPERTY FOR PUBLIC PUR- POSES. WHEREAS, public interest and neces- sity require that the real property hereinafter described be acquired by the City of Alameda for and on behalf of said City's Bureau of ,Electricity for the purpose of landing and anchoring power transmission cables to be laid under the San Leandro Channel be- tween' Bay Farm Island and the main island of the City of Alameda; and WHEREAS, Thomas Wood, also known as Paul Wood, and Vivian Wood, his wife, are the owners of said real property and are willing to sell same to the City of Alameda for the sum of $1,949.10; BE IT ORDAINED BY THE COUN- CIL OF THE CITY OF ALAMEDA: Section 1. That the City of Alameda purchase from Thomas Wood, also known as Paul Wood, and Vivian Wood, his wife, for the sum of $1,949.10, that certain real property situated in the City of Alameda, County of Ala- meda, State of California, particularly described as follows: BEGINNING at a point on the southwestern line of Otis Drive, formerly Front Street, distant thereon northwesterly 139.50 feet from the northwestern line of Mar- ket Street, as said streets are shown on the "Map of the Town of Alameda and Adjacent Lands," filed September 12, 1867 in Book 5 of -Maps, at page 16, in the office of the County Recorder of Ala - meda County;; and running thence along said line of Otis Drive north - westerly 10 feet; thence parallel with said line of Market Street southwesterly' 196.28 feet, more or less, to the southwestern line of Lot 5 in Section 19, Township 2 South, Range 3 West Mount Diablo Base and Meridian, as said lot is shown on the "Map No. 2 of Salt Marsh and Tide Lands, situated in the County of Alameda, State of California ", filed in the office of the Department of Finance, State Lands Commission, formerly the office of the Surveyor General of the State of California; thence along the last named dine south- westerly 10.65 feet to a line drawn southwesterly from the point of beginning, parallel with said line of Market Street; and thence along the line so drawn northeasterly 193.54 feet to the point of beginning, on the following terms and conditions: (a) That good and merchantable title in fee simple in said real property be conveyed to the City of Alameda, free and clear of all objections, liens and encumbrances, excepting those ex- pressly reserved: to the grantors in the instrument of conveyance. (b) That the title to said real prop- erty be evidenced by a policy of title insurance issued by Oakland Title In- surance Company, a corporation, insur- ing title in the City, as provided in the preceding subdivision, said title insur- ance to be at the expense of the City of Alameda. (c) That upon deposit with said title company for delivery to the City of a good and sufficient deed of grant con- veying said property to the City and conditioned upon the issuance of a title insurance policy, as aforesaid, to be ,approved by the City Attorney, a warrant of the Public Utilities' Board be drawn for $1,949.10, payable to the order of and delivered to said Oakland Title Insurance Company, a corpora- tion, as escrow holder, for the purpose of effecting the consummation of said purchase. Section 2. The sum of $2,049.10 is hereby appropriated from Bureau of Electricity Fund to pay the purchase price of said real property, cost of tale insurance, and other expenses. Section 3. This ordinance is hereby declared to be a in e a s u r e of great emergency and shall be in effect im- mediately. The following is a statement of the facts showing the urgency: The property to be acquired is to be part of a project of installing power transmission cables running from said property to Bay Farm Island in a sub - aqueous trench across San Leandro Channel. Much delay has been encount- ered in lining up the project, with the result that prompt action is necessary in order that the work may be com- pleted prior to the setting in of the rainy season.
