AN ORDINANCE AMENDING THE
ALAMEDA MUNICIPAL CODE BY
ADDING TO 'TITLE IV, CHAPTER
3 THEREOF, A ; NEW ARTICLE' TO
BE KNOWN AS ARTICLE 2, RE-
LATING TO THE OPERATION OF
POWER BOATS WITHIN CERTAIN
AREAS.
BE IT ORDAINED BY THE COUN-
CIL OF THE CITY OF - ALAMEDA:
Section 1. That the Alameda Muni-
cipal Code be; and the same is hereby
amended by adding to Title IV, Chap-
ter 3 thereof, a new a r t i c l e to be
known as Article 2, which shall read
as follows:
Article 2. Operation. of Power .Boats
See. 4 -321. Operation of Power
Boats- Prohibited Within Certain
Areas. It shall be unlawful for any
owner, operator, or person in com-
mand of any power boat to operate
same or permit it to be operated
within 200 feet of (1) any beach
frequented by bathers, (2) any
swimming float, diving platform or
life line appurtenant to any such
beach:
Section 2. This ordinance is here-
by declared to be a measure of neces-
sity for the immediate preservation of
the public safety, and shall take effect
immediately. The following is a state-
ment of the facts showing the necessi-
ty for this ordinance becoming effec-
tive immediately. Section 267 Harbors
and Navigation Code permits the
operation of power boats at a speed of
not more than five nautical miles per
hour within the areas designated here-
in. Section 268 Harbors and Navigation
Code authorizes cities to make further
restrictions concerning the navigation
and operation of power boats. The op-
eration of several 'power boats off
Washington Park Beach in the midst of
large groups of swimmers has created
a highly dangerous situation which, in
the interest of public health and safety,
must be promptly corrected.
