AN ORDINANCE AUTHORIZING EXE-
CUTION OF A LEASE OF CERTAIN
TIDE AND SUBMERGED LANDS TO
THE PACIFIC TELEPHONE AND
TELEGRAPH COMPANY.
WHEREAS, The Pacific Telephone
and Telegraph Company, a corporation,
hereinafter called Lessee, has applied
to the City of Alameda for a lease of
certain tide and submerged lands, sit-
uate in the City of Alameda and more
particularly described in the form of
lease hereinafter referred to, for use
in connection with the installation, op-
eration and maintenance of submarine
telephone cables across and under San
Leandro Channel, such lease to be for
a term of 25 years, commencing August
16, 1954, at the total rental of Twenty -
five ($25.00) Dollars, payable upon exe-
cution of said lease, and for the right
and option to renew said lease for an
additional term of 25 years, at the total
rental of Twenty -five ($25.00) Dollars,
and otherwise upon the same terms
and conditions as the original lease;
and
WHEREAS, a form of lease contain-
ing the covenants and agreements to
be made between the City of Alameda
and said Lessee has been prepared and
submitted to this Council at its regular
meeting of July 20, 1954, and ordered
filed with the Clerk of said City and
marked "Filed July 20, 1954 "; and
WHEREAS, it is in the public inter-
est that said lands be leased for the
time and purpose set forth in said form
of lease;
NOW THEREFORE, BE IT ORDAIN-
ED BY THE COUNCIL OF THE CITY
OF ALAMEDA as follows:
Section 1. That the form of lease
referred to in the preamble hereof, and
the terms and provisions thereof, be,
and the same are hereby approved.
Section 2. That the lands described
in said form of lease be, and the same
are hereby leased to The Pacific Tele-
phone and Telegraph Company, a cor-
poration, upon the terms and condi-
tions of said form of lease.
Section 3. That the Mayor of the
City of Alameda be, and he is hereby
authorized and directed to execute,
and the City Clerk to attest, as the act
and deed of the City of Alameda, a
lease in the form and containing the
terms, covenants and agreements set
forth in the aforesaid form of lease.
Section 4. This ordinance is hereby
declared to be a measure of great
emergency, and shall be in effect im-
mediately. The following is a state-
ment of the facts showing the urgency:
The Lessee must have the lease in
hand prior to inviting bids for excava-
tion of the underwater trench in which
its cables will be laid; the City's Bu-
reau of Electricity will share the trench
with the Lessee for its power transmis-
sion cables to Bay Farm Island; it is
necessary, from the standpoint of both
the Lessee and the City, that the
trenching be gotten under way prompt-
ly, in order that it may be completed
prior to the setting in of the rainy
season.
