AUTHORIZING EXECUTION OF
LEASE OF CERTAIN REAL PROP -
ERTY TO FOSTER AND KLEISER
COMPANY, FOR ADVERTISING
PURPOSES.
WHEREAS, Foster and Kleiser Com-
pany, hereinafter called Lessee, has
applied to the City of Alameda for a
lease to certain real property owned
by said City and more particularly de-
scribed in the form of lease hereinaf-
ter referred to, for the purpose of con-
structing and maintaining thereon one
(1) outdoor advertising structure (al-
ready in place on said property), such
lease to be for a period of ten (10)
years, commencing April 1, 1955, at a
rental of One Hundred ($100.00) Dol-
lars per month, payable monthly in
advance; and
WHEREAS, a form of lease contain-
ing the covenants and agreements to be
made between the City of Alameda and
the Lessee has been prepared and sub-
mitted to this Council at its regular
meeting of June 7, 1955, and ordered
filed with the City Clerk of said City
and marked "Filed June 7, 1955 "; and
WHEREAS, the Council of the City of
Alameda has found and determined
that said real property be leased for
the purpose set forth in said form of
lease;
NOW THEREFORE, BE IT OR-
DAINED BY THE COUNCIL OF THE
CITY OF ALAMEDA, as follows:
Section 1. That the form of lease re-
ferred to in the preamble hereof and
the terms and provisions thereof be,
and the same are hereby approved.
Section 2. That the real property
described in said form of lease, as
limited by the rider thereto attached,
be, and the same is hereby leased to
said Foster and Kleiser Company, up-
on the terms and conditions of said
form of lease.
Section 3. That the Mayor of the City
of Alameda be and he is hereby author -
ized and directed to execute; and the
City Clerk to attest, as the act and
deed of the City of Alameda, a lease in
the form and containing the terms and
conditions set forth in the aforesaid
form of lease.
Section 4. '`his ordinance is hereby
declared to be a measure of emergency
and shall be in effect immediately,
Following is a statement of the facts
showing the urgency:
Foster and Kleiser Company already
has in place on the property the bill-
board for the maintenance of which
the proposed lease is being made. This
board was erected during the time the
entire parcel was under lease to Deem-
er Buick Co., the advertising company
being a sub - tenant of the Buick peo-
ple. The Deemer lease has expired,
the board continues on the property
and the City should be in position to
collect the rental on the board at the
earliest possible time.
