AN ORDINANCE AMENDING THE
ALAMEDA MUNICIPAL CODE BY
AMENDING SUBSECTION 7 OF
SECTION 3 -10116 THEREOF, RE-
LATING TO SALES AND USE
TAXES.
BE IT OR,DAINEI3 BY THE -COUN-
CIL OF THE CITY Off ALA.MEDA:
Section 1. That Subsection 7 of Sec-
tion _3- 10116 of the Alameda Municipal
Code be, and it is hereby amended to
read as follows:
7. Sales of property which is shipped
to a point outside this city pursuant to
the contract of sale by delivery by the
retailer to such point by means of
(A) facilities operated by the retailer;
(B) delivery, by the retailer to : a car -
rier for shipment to a consignee at
such point; or (C) delivery by the re-
tailer to a customs broker or forward-
ing agent for shipment to a point out -
side this city:
The retailer shall furnish the City
Treasurer with such certificate or other
evidence as may be required showing
such property is exempt from the City
Sales Tax under this provision.
The word "facilities" as used herein
shall mean vehicles of any type or
description owned and operated by the
retailer as an integral part of his busi-
ness and devoted to the transportation
and carriage of merchandise handled
by the retailer.
Section 2. This ordinance is hereby
declared to be 'a measure of great ne-
cessity and shall bean effect immedi-
ately. 'I he following is a statement of
the facts showing the necessity there-
for:
Subsection 7 of Section 3- 10116 as
presently in effect permits the claiming
of large numbers of exemptions on de-
liveries to a point outside this city,
resulting in a considerable loss of
revenue to the city. The amendment
will effect a great reduction in the
exemptions which may be properly
claimed,.
