AN ORDINANCE AUTHORIZING THE
ACQUISITION OF CERTAIN REAL
PROPERTY FOR PUBLIC OFF-
STREET PARKING PURPOSES
WHEREAS, public interest and ne-
cessity require that the real property
hereinafter described be acquired by
the City of Alameda for use by said
City for public off-street motor ve-
hicle parking places, including prop-
erty necessary or convenient for in-
gress thereto or egress therefrom; and
WHEREAS, Robert Russell Franck,
a married man, and Arlene June
Franck, an unmarried woman, are the
owners of the real property herein-
after described and are willing to sell
the same to the City of Alameda for
the sum of $10,000;
BE IT ORDAINED BY THE COUN-
CIL OF THE CITY OF ALAMEDA:
Section 1. That the City of Alameda
purchase from Robert Russell Franck,
.a married man, and Arlene June
Franck, an unmarried woman, for
the sum of $10,000,00, that certain real
property situated in the City of Ala-
meda, County of Alameda, State of
California, more particularly de-
scribed as follows:
PORTION of Lot 8, in Block
"U," as said lot and block are
shown on the "Map of Lands Ad-
jacent to the Town of Encinal,
Alameda County, Cal.," filed May
28, 1867 in Book 19 of Maps, at page
53, in the office of the County
Recorder of Alameda County, de-
scribed as follows:
BEGINNING at a point on the
northeastern line of Alameda Ave-
nue, distant thereon southeasterly
190 feet from the southeastern line
of Oak Street; and running thence
along said line of Alameda Avenue
southeasterly 10 feet to the south-
eastern line of said Lot 8; thence
along the last named line north-
easterly 150 feet to the northeast-
ern iiiie of said Lot 8; thence
along the last named line north-
westerly 50 feet to the northwest-
ern line of said Lot 8; thence along
the last named line southwesterly
90 feet to a point distant thereon
northeasterly 120 feet from said
line of Alameda Avenue; thence
at right angles southeasterly 34
feet; thence in a direct line south-
erly 22 feet to a point on a line
drawn northerly from the point of
beginning and at right angles to
said line of Alameda Avenue, dis-
tant along said line so drawn
northeasterly 99 feet from said line
,of Alameda Avenue; thence along
the line so drawn southwesterly 99
feet to the point of beginning,
on the following terms and conditions:
(a) That Robert Russell Franck, a
married man, and Arlene June Franck,
an unmarried woman, reserve unto
themselves, their tenants, customers
and employees, the right of ingress
and egress over the southeasterly
10.00 feet of the described property
from Alameda Avenue to the north-
eastern line of Lot 8, for the benefit
of ihemselves and their assigns and
properties immediately adjacent to
said ten-foot reservation.
(b) That good and merchantable
title in fee simple in said real prop-
erty, subject to the easement set out
above, be conveyed to the City of
Alameda, free and clear of all objec-
tions, liens and encumbrances; City
and County taxes to be prorated as
of date of closing of this sale.
(c) That the title to said real prop-
erty be evidenced by a policy of title
insurance issued by Oakland Title
Insurance Company, a corporation, in-
suring title in the City, as provided
in the preceding subdivision, said
title insurance to be at the expense
of the City of Alameda.
(d) That upon deposit with said
title company for delivery to the City
of a good and sufficient deed of grant
conveying said property to the City
and conditioned upon the issuance of
a title insurance policy, as aforesaid,
to be approved by the City Attorney,
a warrant of the City be drawn for
$10,000.00, payable to the order of
and delivered to said Oakland Title
Insurance Company, a corporation, as
escrow holder, for the purpose of ef-
fecting the consummation of said pur-
chase.
Section 2. The sum of $10,100.00 is
hereby appropriated from the Off -
Street Parking Project Construction
Fund to pay the purchase price of
said real property, cost of title in-
surance policy, and other expenses.
Section 3. This ordinance shall be
in full force and effect from and
after the expiration of thirty (SO)
days from the date of its final pas-
sage.

1, the undersigned, hereby certify
that the foregoing Ordinance was
duly and regularly adopted and passed
by the Council of the City of Alameda
in adjourned regular meeting assem-
bled on the 22nd day of May, 1956,
by the following vote, to wit:
AYES: Councilmen Haag, Hove, Mc-
Call, Moresi and President Kranelly,
(5).
NOES: None.
ABSENT: None.
