Ordinance 1175Alameda Clity Ordinances Ordi.ance No. 1175 New Series AN ORDINANCE AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY FOR PUBLIC OFF- STREET PARKING PURPOSES WHEREAS, public interest and ne- cessny require that the real prop- erty hereinafter described be acquired by the City of Alameda for use by said City for public off-street motor vehicle parking places, including prop- erty necessary or convenient for in- gress thereto or egress therefrom; and WHEREAS, VINCENT BONDI and ANGELINA BONDI, his wife, are the owners of the real property herein- after described and are willing to sell the same to the City of Alameda for the sum of $14,500.00; BE IT ORDAINED BY THE COUN- CIL OF THE CITY OF ALAMEDA: Section 1, That the City of Alameda purchase from VINCENT BONDI and ANGELINA BONDI, his wife, for the sum of $14,500, that certain real prop- erty situated in the City of Alameda, County of Alameda, State of Cali - fornia, more particularly described as follows: PORTION of Lot 8, in Block ­U," as said lot and block are shown on the "Map of Lands Ad- jacent to the Town of Encinal, Alameda County, Cal.,­ filed May 28, 1867, in Book 19 of Maps, at page 53, in the office of the County Recorder of Alameda County, described as follows: BEGINNING at a point on the northern line of Alameda Avenue, distant thereon easterly 150 feet from the point of intersection thereof with the eastern line of Oak Street; running thence north- erly parallel with said line of Oak Street, 120 feet; thence at right angles easterly 34 feet; thence southerly in a direct line to a point which would be intersected by a line drawn northerly from the northern line of Alameda Avenue, at right angles thereto, and 190 feet at right angles easterly from the said eastern line of Oak Street (said point of intersection to be 99 feet northerly on said line so drawn from the northern line of Alameda Avenue); thence south- erly from said point of intersec- tion and parallel with Oak Street, 99 feet to the northern line of Alameda Avenue; thence westerly along said last named line, 40 feet to the point of beginning, on the following terms and condi- tions: (a) That good and merchantable title in fee simple in said real prop- erty be conveyed to the City of Ala- ineun, free and clear of all objections, liens and encumbrances. (b) That the title to said real prop- erty be evidenced by policy of title insurance issued by Oakland Title Insurance Company, a corporation, in- suring title in the City, as provided in the preceding subdivision, said title insurance to be at the expense of the City of Alameda. (c) That upon deposit with said title company for delivery to the City of a good and sufficient deed of grant conveying said property to the City and conditioned upon the issuance of a title insurance policy, as aforesaid, to be approved by the City Attorney, a warrant of the City be drawn for $14,500.00, payable to the order of and delivered to said Oakland Title In- surance Company, a corporation, as escrow holder, for the purpose of ef- fecting the consummation of said pur- chase, Section 2. The sum of $14,615.00 is hereby appropriated from the Off- Street Parking Project Construction Fund to pay the purchase price of said real property, cost of title in- surance policy, and other expenses. Section 3. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage. R. P.
