AN ORDINANCE AUTHORIZING THE
ACQUISITION OF CERTAIN REAL
PROPERTY FOR PUBLIC OFF-
STREET PARKING PURPOSES
WHEREAS, public interest and ne-
cessity require that the real prop-
erty hereinafter described be acquired
ay the City of Alameda for use by
said City for public off-street motor
vehicle parking places, including prop-
erty necessary or convenient for in-
gress thereto or egess therefrom; and
WHEREAS, CAT ERINE MANNING,
a widow, is the owner of the real
property hereinafter described and is
willing to sell the same to the City
of Alameda for the sum of $14,000.00;
BE IT ORDAINED BY THE COUN-
CIL OF THE CITY OF ALAMEDA:
Section 1. That the City of Alameda
purchase from Catherine Manning,
a widow, for the sum of $14,000.00,
that certain real property situated in
the City of Alameda, County of Ala-
meda, State of California, more par-
ticularly described as follows:
BEGINNING at a point on the
southern line of Haight Avenue,
distant thereon 180 feet easterly
from the eastern line of Webster,
formerly 7th, Street; running
thence along said line of Haight
Avenue easterly 30 feet; thence at
right angles southerly 132.50 feet;
thence at right angles westerly 30
feet; and thence at right angles
northerly 132.50 feet to the point
of beginning,
on the following terms and condi-
tions:
(a) That good and merchantable title
in fee simple in said real property be
conveyed to the City of Alameda, free
and clear of all objections, liens and
encumbrances; City and County taxes
to be prorated as of date of closing
of this sale.
(b) That the title to said real prop-
erty be evidenced by a policy of title
insurance issued by Alameda County-
East Bay Title Insurance Company, a
corporation, insuring title in the City,
as provided in the preceding subdi-
vision, said title insurance to be at
the expense of the City of Alameda.
(c) That upon deposit with said title
company for delivery to the City of
a good and sufficient deed of grant
conveying said property to the City
and conditioned upon the issuance
of a title insurance policy, as afore-
said to be approved by the City At-
torn:ey, a warrant of the City be
drawn for $14,000,00, payable to the
order of and delivered to said Ala-
meda County-East Bay Title Insur-
ance Company, a corporation, as es-
crow holder, for the purpose of ef-
fecting the consummation of said pur-
chase.
Section 2. The sum of $14,110.00 is
hereby appropriated from the Off -
Street Parking Project Construction
Fund to pay the purchase price of
said real property, cost of title in-
surance policy, and other expenses.
Section 3. This ordinance shall be
in full force and effect from and after
the expiration of thirty (30) days from
the date of its final passage.
