AN ORDINANCE AUTHORIZING THE
ACQUISITION OF CERTAIN REAL
PROPERTY FOR PUBLIC OFF-
STREET PARKING PURPOSES.
WHEREAS, public interest and neces-
sity require that the real property
hereinafter described be acquired by
the City of Alameda for use by said
City for public off-street motor vehicle
pa rking places, including property
necessary or convenient for ingress
thereto or egress therefrom; and
WHEREAS, Alameda Aerie No. 1076,
Fraternal Order of Eagles, a corpora-
tion, is the owner of the real property
hereinafter described and is willing to
sell the same to the City of Alameda
for the sum of $17,650.00;
BE IT ORDAINED BY THE COUN-
CIL OF THE CITY OF ALAMEDA:
Section 1. That the City of Alameda
purchase from Alameda Aerie No. 1076,
Fraternal Order of Eagles, a corpora-
tion, for the sum of $17,650.00, that
certain real property situated in the
City of Alameda, County of Alameda,
State of California, more particularly
described as follows:
THE SOUTHEASTERN 49 feet,
front and rear measurement, of
Lot 7, in Block "U," as said lot and
block are shown on the "Map of
Lands Adjacent to the Town of
Encinal, Alameda County, Cal.,"
filed May 28, 1867, in Book 19 of
Maps, at page 53, in the office of
the County Recorder of Alameda
County,
on the following terms and conditions:
(a) That Alameda Aerie No. 1076,
Fraternal Order of Eagles, a corpora-
tion, reserve unto itself an easement
through the above described property
for ingress and egress of vehicles and
pedestrians, to the back portion of
certain real property retained by
grantor and described as Lot 6, Block
_U," as said lot and block are shown
on the "Map of Lands Adjacent to the
Town of Encinal, Alameda County,
Cal.," filed May 28, 1867, in Book 19
of Maps, at page 53, in the office of
the County Recorder of Alameda
County.
The real property to be granted to
the City of Alameda, above described,
is to be used for City owned off-street
parking facilities. The easement re-
ferred to in the above paragraph shall
follow the normal traffic circulation to
be set up in such off-street parking
facilities, and shall be a 10-foot wide
lane in such traffic circulation pattern.
(b) That good and merchantable title
in fee simple in said real property,
subject to the easement set out above,
be conveyed to the City of Alameda,
free and clear of all objections, liens
and encumbrances; City and County
taxes to be prorated as of date of
closing of this sale
(e) That the title to said real prop-
erty be evidenced by a policy of title
insurance issued by Oakland Title In-
surance Company, a corporation, in-
suring title in the City, as provided
In the preceding subdivision, said title
insurance to be at the expense of the
City of Alameda.
(d) That upon deposit with said title
company for delivery to the City of a
good and sufficient deed of grant
conveying said property to the City
and conditioned upon the issuance of
a title insurance policy, as aforesaid,
to be approved by the City Attorney,
a warrant of the City be drawn for
$17,650.00, payable to the order of and
delivered to said Oakland Title Insur-
ance Company, a corporation, as es-
crow holder, for the purpose of effect-
ing the consummation of said purchase.
Section 2. The sum of $17,800.00 is
hereby appropriated from the Off -
Street Parking Project Construction
Fund to pay the purchase price of
said real property, cost of title insur-
ance policy, and other expenses.
Section 3. This ordinance shall be
in full force and effect from and after
the expiration of thirty (30) days from
the date of its final passage.
