Ordinance No. 1191
AN ORDINANCE AUTHORIZING THE
EXCHANGE OF - REAL PROPERTY
WHEREAS, public interest and ne-
cessity require that certain real prop-
erty hereinafter described be acquired
by the City of.Alameda for street im-
provement purposes; and
WHEREAS, the owner, M. E. LEE,
of the said real property, has agreed
to exchange said real property for
other real property owned by the City
of Alarneda, hereinafter described;
and
WHEREAS, the values of the respec-
tive parcels of real property are
equal;
NOW THEREFORE, BE IT OR-
DAINED BY THE COUNCIL OF THE
CITY OF ALAMEDA:
Section 1. That the City of Alameda
accept from M. E. Lee the transfer of
that certain real property situate in
the City of Alameda, County of Ala-
meda, State of California, more par-
ticularly described as follows:
BEING a parcel of land desig-
nated as Parcel 2 in the deed from
J. H. Taxman and Bessie May Tar-
man, his wife, to M. E. Lee, as re-
corded August 13, 1947, in Fiber
5181, page 331 of Official Records of
A'amcda County, California; said
Parcel situate in the City of Ala-
meda, County of Alameda, State of
California, and further described to
wit:
BEGINNING at the most western
corner of Lot 6, in Section 30, in
Township 2 South, Range 3 West,
Mount Diablo Base and Meridian,
in the district of lands subject to
sale at San . Francisco being the
premises described in Lot Patent
from the United States of America
to Alfred. Wright, dated June 1,
1974, and recorded in Book "A" of
Patents, page 627, in the office of
the County Recorder of Alameda
County; said corner bears south 82'
47 24" west 111.39 feet from United
States Coast and Geodetic Survey
Station "Cart J"; based on the Cali-
fornia Coordinate System Zone 3, as
are all bearings and distances in
this description; thence. along the
southwestern boundary of said Lot
6, south 72' 56' 02" east 245.88 feet
to a point on the southwestern
boundary line of that certain parcel
of land described in deed from F. J.
Hambly, a single man, to E. B. and
A. L. Stone Company, a corpora-
tion, dated June 15, 1925, and re-
corded June 23, 1925, in Book 1024
of Official Records of Alameda
County, page 288; thence north 39'
16' 28" west 88.80 feet along the last
named line to the northern line of
Lot 6; thence north 88 54 If)" west
178,87 feet along the said northern
line of Lot 6 to the point of be-
ginning; CONTAINING 0.14 acres;
subject to Assessment No. 17-1 for
Bay Farm Island Sewering Assess-
ment, and that, in consideration there-
of, the City of Alameda transfer to
the aforesaid M. E. Lee that certain
real property owned by the City of
Alameda, situate in the City of Ala-
miwi.q rmintv of Alameda. State of
California, more particularly described
as follows:
BEGINNING at a point on the
northeastern line of Maitland Drive,
distant thereon north 32' 11' 111
west 70.77 feet from the northwest-
ern line of Fitchburg Avenue; and
running thence north 57 48' 49"
east 110 feet; thence north 32 11'
11" west 11.15 feet; thence north
55 52' 03" west 124,12 feet to a
line drawn north 6 27' 55" west from
the point of beginning; and thence
south 6 27' 55" east 138.56 feet to
the point of beginning;
subject to Assessments Nos. 122 and
123 for Bay Farm Island sewering.
Said exchange shall be subject to the
following terms and conditions:
(a) That good and merchantable
title in fee simple. in the said real
property to be conveyed to City of
Alameda, subject to the assessment
set out above, be conveyed free and
clear of all objections, liens and en-
cumbrances; City and County taxes to
be prorated as of the date of closing
of this exchange,
(b) That the title to said real prop-
erty conveyed to the City of Alameda
be evidenced by a policy of title
insurance issued by Oakland Title
Insurance Company, a corporation, in-
suring title in the City of Alameda
pursuant to Section I (a) above.
(c) That each party hereto shall
pay his own respective closing costs.
including title insurance and escrow
fees.
Section 2. That there is hereby ap-
propriated from the Capital Outlays
Fund the amount of $25.00 to pay for
the expenses set out in Section I (c)
above,
Section 3. That the Mayor. of the
City of Alameda is hereby authorized
and directed to execute. and deliver
the deed .of the City of Alameda, for
and on behalf of the City of Alameda,
to the real property to be conveyed
by the City of Alameda as described
herein, and the City Clerk is directed
to attest the same, as soon as this
ordinance becomes effective.
Section 4. This ordinance shall be
in full force and effect from and after
the expiration of thirty (30) days from
the date of its final passage.

1, the undersigned, hereby certify

the Council of the City of Alameda in
adjourned regular meeting assembled
on the 31st day of July, 1956, by the

Call, Moresi and President Kranelly,
