ORDINANCE THE !CITY OF ALAMEDA AUTHORIZING A CON- TRACT BETWEEN: THE ' CITY COUNCIL OF THE CITY OF ALA:- MEDA AND THE BOARD OF AD- MINISTRATION, CALIFORNIA STATE EMPLOYEES' RETIRE- MENT SYSTEM, PROVIDING FOR THE PARTICIPATION OF SAID CITY OF ALAMEDA IN SAID STATE EMPLOYEES' RETIRE- MENT SYSTEM, :MAKING' ITS EM- PLOYEES MEMBERS OF ' SAID SYSTEM; WITH. THE : EXCEPTION OF LOCAL POLICEMEN, FIRE- MEN AND HEALTH DEPART- MENT EMPLOYEES, AMENDING ORDINANCE NO. 673 N. S. TO EXCLUDE EMPLOYEES WHO EN- .TER INTO THE STATE EMPLOY- EES' RETIREMENT 'SYSTEM. BE IT. ORDAINED BY THE COUN- CIL OF THE CITY OF ALAMEDA as follows: Section 1 That a contract is hereby authorized between the :City Council of the Cityy of .Alameda and. the Board of Zdministration, California State Employees' Retirement System, a copy of said contract being at- tached hereto, marked Exhibit "A," and by such reference made a part hereof as though herein set out in full. Section 2. The Mayor of the City of Alameda is hereby authorized, empowered and directed to execute said contract for .and on behalf of the City of Alame-da. Section .3. Ordinance No. 673 New Series of . the City of Alameda is hereby amended by adding. thereto a new section 31, which shall read as follows: Section 31. As of the effective date that the City of Alameda commences participation in the California State Employees' Re- tirement System, this ordinance, as amended. shall be inapplicable to all employees of the 'City of Alameda covered herein, except - ing those employees situated in the City of Alameda Health De- partment: Section 4. This ordinance shall be in. full force and effect from and after the expiration of thirty (30) days from the date of its final pas- sage, and prior to the expiration of three M. days from the passage thereof shall be published at least once in 'the Alameda Times -Star, a newspaper of general circulation; published in the City :of Alameda. City of Alameda (SEAL) CONTRACT Between City Council of the City of Alameda and the Board of Adminis- tration of the California State Em- ployees' Retirement System:: This Agreement made this......day of:.:. 1956, by and between the Legislative Body of City of Ala- meda hereafter referred to as "Pub- lic Agency," and the. Board of Ad- ministration, California State Em- ployees' Retirement System, hereafter referred to as: "Board." WITNESSETH In .consideration of the cavenants and agreements hereinafter contain- ed and on the part of both parties to be kept and performed, : Public Agency and Board hereby agree as follows: 1. Public Agency is to participate in the State Employees' Retirement System, subject to the provisions of the State Employees' Retirement Law. 2.' Public Agency shall participate in said Retirement System, making its employees members of said Sys- tem, from and after Jan. 1, 195_:: -. 3. Employees of Public Agency in the following classes shall become members of said Retirement .System in accordance with the provisions of said. Board and Public : Agency agree that, except as provided in paragraph 12, no adjustment shall be made in the amount of contributions' provided in paragraph 12a on account of prior service, or in the percentage provided in ' paragraph 12b, because of varia- tions in the numbers' of em loyees who become members of said Retire ment System on the effective date hereof, from the number listed above, due to termination of service by such causes as death, resignation or dis- charge, or the :employment of indi- viduals . not included in said number. 4. Age 60 shall be the normal mini- mum. age for retirement for service, of miscellaneous members employed by public agency, that is, members nthpr thin Lnral FirPmpn T.nrwnl Tsn- e New Series Ordinance No. - 1201 licemen and County; :Peace : Officers, and one - sixtieth shall be the fraction of: final.' compensation, :: as defined in said Retirement :Law,- to be :provided on the average, for each year of service as a member, by the mem- .hers' and Public . ::Agency's normal contributions, upon.: retirement at said minimum :age. . 5. Benefits on account of prior service, .that is, service credited here- under as : rendered to Public Agency prior to the effective date of partici- pation to respective members em- ployed by Public Agency as local Firemen, Local Policemen or County Peace Officers shall be allowed only as a percentage of the average sal- ary specified in said Retirement Law, for each year of such service, and said percentage shall be --per cent of the fraction of frr� I mppensation, as defined In the State co Employees' Retirement Law, for each. year of service rendered after' said date, as determined for . said respective mem - bers . under said law, for retirement for service at age 55, or upon qualifi- cation for service retirement at a higher age,. If a member retires for service before attaining age 55, his prior service pension shall be re- duced to that amount which the value of the pension as deferred to age 55 will purchase at the actual age of retirement. 6. Prior service benefits to miscel- laneous members employed by Pub- lic Agency, that is, members other than Local Firemen, Local Policemen or ; County Peace Officers, upon re- tirement: for service at the normal minimum : age . entered in paragraph 4 hereof. shall be allowed only as a percentage of the :average salary specified in Section 21253: of said Retirement Law, for each year of such service, and said percentage shall be. 100 per cent: of the percent- aye determined : under said section. If a member retires for service before attaining the normal: minimum : age entered. in paragraph: 4 hereof; his prior service pension shall be re- duceu to that amount which the value of the :pension : as deferred : to said minimum age will purchase at the actual age of retirement. 7, if the :fraction stated in the pre- ceding paragraph is one - sixtieth, the provisions of Section :21251.1 :, of the State Employees' :Retirement Law, providing fora guaranteed percent- age of final compensation for each year of. current service. as a member, shall apply to . employees of Public Agency who become members of said Retirement System. 8. The provisions of Section 21252.4 of the State Employees' Retirement Law, providing for a .guaranteed per= centage of final compensation for each year of current : as a nnember, .....,..apply to employees of Public Agency who become. mem- bers of the Retirement System as Local Firemen, Local: Policemen or County Peace Officers. 9. The provisions of :Section 21258b of the State Employees' Retirement Law, guaranteeing a minimum :'re- tirement allowance under certain conditions :shall apply to , employees of :Public Agency who :become merit- bers of said Retirement System. 10. The provisions of :Section 21367.5 of the State Employees' Retirement Law, providing a $400: death benefit nft. r rPtirAmPnt chall nnn1v to pm- ployees of Public : Agency who :be- come members. of said " Retirement System. 11. The provisions of Section 20025` of the State Employees' Retirement Law, providing for the portion of compensation which .shall be includ ed in computations: under the Re tirement . Lain shall apply to employ- ees of Public Agency who :become members of said Retirement Sys- tem. 12. Public Agency shall contribute to said Retirement System as fol- lows a. The sum of $31,304.70 per annum; payable in equal monthly . or more frequent installments as Board shall require, for a period of 30 years, .on account of the liability for benefits based on service rendered to Public Agency prior to the effective date hereof.. b..5,328 per cent of total salaries paid by Public .Agency each month to its employees who are members of said Retirement System, provided that only salary earned as members of said System shall be included in said total salaries, and the employ- ees who. are. members of said Sys tem shall include employees who be- come members upon the effective date Hereof and employees . who be- come members thereafter. c. A reasonable amount per an num, as fixed by Board, payable in equal monthly or less frequent in- stallments, as Board shall require, to cover the costs of .administering said System as it affects the employ- ees of ePublic Agency, not including the costs of special valuations or of the periodical investigation. and :val= uation required by law, provided that said amount shall be determined on the basis . of "the number of employ- ees of : Public Agency who are mem- bers on July: 1st . of the :respective fiscal e years, or with : respect to. the first year of :participation, on the effective'; date of said participation. d. A' .amount as fixed by the hoard, payable in one install - ment from time to. time as the occa- sions arise, to cover the costs of spe cial valuations on : account of em- ployees : of Public Agency, and the costs of the periodical investigation into the experience under > said Re- tirement System, as It - affects said employees, and the valuation of the assets and liabilities of said System on account of said employees. Contributions required of Public Agency and its employees shall be s'ubl ect to adjustment by : the Board of Administration on account of amendments to the :State Employees' Retirement Law, and on :account of experience under. the .Retirement System, as . determined by the peri- odical investigation; valuation and determination. provided for by said Retirement. Law. 13. Contributions required of Pub -. lic Agency under paragraph 12 im- mediately preceding, and :eontribu- tions required of Public Agency's employees who r are members of said System, shall be paid by Public Agency to the State Employees' Re- tirement System within thirty days after the end of the month or longer period to which said contributions refer. Payments of Public Agency to Board may be made in the form of warrants, bank checks, bank drafts,. certified checks, money or- ders, or cash.
