LOTS IN THE CITY OF ALAMEDA
BY ADDING TO CHAPTER 3,
TITLE XV'II, . OF . THE ALAMEDA
MUNICIPAL CODE, A NEW ARTI-
CLE 7; PRESCRIBING REGULA-
TIONS RELATIVE TO TRAFFIC
MOVEMENT AND PARKING OF
VEHICLES THEREIN; PROVIDING
FOR THE INSTALLATION,. OP-
ERATION, MAINTENANCE, SU-
PERYISION REGULATION AND
CONTROL OF THE USE :OF P.ARK-
ING METERS THEREON- PRE-
SCRIBING RATES TO BE CHARD-
ED FOR PARKING; AND PRE-
.SCRIBING PENALTIES FOR VIO-
LATIONS OF THE PROVISIONS
HEREOF.
BE : IT ORDAINED BY THE "COUN-
CIL OF THE CTTY OF ALAMEDA:
SECTION 1. Chapter 3 of Title XVII
of the "Alameda Municipal Code is
hereby amended by adding thereto
a new Article 7, which shall read as
follows:.. 7. Public Off- Street
Parking Lots
Sec, 17 -371.: Establishment of Pubs
lic . Off- Street Parking Lots. Public
off- street parking lots are hereby ea-
.tablished in the City of Alameda.;
and all of the provisions of this or-
dinance shall be applicable thereto.
Such off - street parking lots are those
areas so designated by resolution. of
the Council : of the. City of Alameda.
Sec. 17 -372. Method of Regulation.
The method of regulation and control
of parking or standing of vehicles in
public off - street parking lots shall
be determined by the City Council,
and may be by parking meters, at-
tendants or any other appropriate
means.
On those public off- street parking
lots which are to be controlled by
parking meters the City; Treasurer
shall cause parking meters to be in-
stalled and maintained.
Sec. 17 -373. Time of Operation of
Parking ; Meters, % The provisions of
this ; ordinance relating to the opera-
tion of parking meters' on public :off-
street parking lots shall be: effective
during the hours and on the dayys
established by resolution of the
Council of the City of Alameda and
as "so designated by appropriate
markings or signs.
Sec. 17-374. Rates for Use of public
Off-Street Parking. Lots. .The rates
to be charged for Parkin gg -in : public
off- street parking lots and the hours
during which the rates will be effec-
tive ; shall be established by resolu -.
tion of the Council of the City of
Alameda . and .shall be . designated by
appropriate markings or signs.
Sec. 17 -375. Operational Procedure
to be Followed. Immediately after
occupancy of a ; parking space, . the
operator of a vehicle shall; unless
there is unexpired time on the park
ing meter, deposit or. .cause to have
deposited in the :parking meter des-
ignated for said parking space a coin
of the United States of a denomina-
tion designated on said meter, or,
an :official token issued by the City
of Alameda, as described in = Section
17 -378 hereof, and unless said park=
inL meter is of the 'autayna+ir +uric
which requires no manual opera-
lion other than the deposit of a coin,
completely turn a ::crank, knob . or
handle in accordance with the.. in-
structions on said parking meter.
Sec.. 17 -376. Unlawful to , Park After
Meter Time : Has Expired. It shall
be unlawful for the - operator of any
vehicle to permit said vehicle to
remain parked in any parking space
during any time that the meter is
showing a signal indicating that such
space is illegally in use other than
such time immediately after the on g-
inal ' occupancy as is necessary to
operate .the meter to show legal park-
ingg
Se.: 17 -377. Unlawful to. Extend
Time Beyond Lirnit..It shall be un-
lawful and a violation of the provi-
sions of : this ordinance for any perr
son to follow the operational proced-
ure or any .part of the operational
procedure for the purpose of increas-
ing or extending the parking time
of any vehicle- beyond the legal park-
ing time which has been established
for the parking space: adjacent to
which said parking meter is placed.
Sec. 17 -378. Improper Use of Motor.
It shall be unlawful to . deposit or
cause to be deposited in any park-
ing meter any defaced or bent coin,
or any slug, device or metallic sub -
stance for a coin of the United, States,
or for any person to deface, injure,
tamper with, open or wilfully break
destroy or impair the usefulness of
any parking meter; ; provided, how-
ever, nothing herein shall : prevent
the use in such public off - street park-
ing lot; meters of a metallic token
duly and officially issued by the
City of Alameda for such purpose.
Said metallic token shall bear the
legend "City of Alameda Parking
Lots —Good for'.One Hour," :and shall
be inscribed with the .year of issue.
Sec. 17 =379.: Deposit of Coins in Me-
ter by.: Unauthorized Person. It shall
be unlawful for any person, other
than the owner or operator of a
vehicle to deposit any coin in any
parking meter without the knowledge
or consent . of said owner or operator
of the vehicle using the parking
space.
Sec. 17 -3710. ' Parking Meters and
Parking Meter .Standards Not to be
Used for Certain Purposes.:. It shall
be unlawful for any person : to attach
anything to or allow a bicycle . mews-
rack or any other article or thing to
lean against a .parking meter or a
parking meter standard.
Sec. 17 -3711. Overtime Parking
The limit of parking time and the
days . and hours during which park-
ing time limits ' shall ' apply on pub-
lic off- street parking lots shall be
established by resolution. of the
Council of the City . of Alameda.
When appropriate signs or mark-
ings designating such parking time
limits are in place giving notice
thereof, it shall be unlawful for the
operator of any vehicle to stop;
stand or park said vehicle on any
public off - street parking Iot for long-
er than the permitted tune.
Sec. 17 -3712. Parallel or . Diagonal
Parking. When a parking space In
any public off - street parking lot is
parallel with the adjacent meters,
any vehicle parked or standing in
such parking space . shall be parted
or 'shall >stand so that the foremost
part of said vehicle shall be nearest

the parking space. When a parking
space in : any public off- street park-
ing .lot is diagorial or at right angles
to. the parking meters any vehicle
parking .or standing in such parking
space shall be parked or .shall stand
with the foremost part of ' such be-
hicle nearest to the parking meter
designated for the parking space.
Sec. 17- 3713. Parking Within Park-
ing Spaces. Parking spaces on public
off - street parking lots shall be desig-
nated by lines , or other appropriate
marl�ings. When parking spaces are
so designated,. it. shall be unlawful
for the operator of any vehicle to
stop, stand or park said vehicle
other than in a regularly designated
parking or loading space, across any
such line or marking, or in such po-
sition that said : vehicle . shall not be
entirely within the area so designated
as a parking space. No vehicle shall
be parked, stopped, nor shall stand
either wholly or partially in any
driveway of any public off - street
parking lot or in any manner which
shall obstruct or interfere with the
free .movement of vehicles in such
driveway or in any manner so as
to obstruct or otherwise prevent or
interfere with ingress to or egress
from any regularly designated park-
ing space.
Seca 17 -3714. Use of Entrance and
Exit. It shall be unlawful .for any
person .to . enter any public off - street
parking lot over any area or drive-
way or the portion between any
curb returns which is not marked
with the word "entrance' or other -
wise indicated by arrows,. signs or
words that it . is a driveway or place
for the entering: of such parking lot.
It shall be unlawful for any per-
. son to. move. any vehicle from any
such parking ..lot :. into any public
way over any area except an area
marked with the word "'exit" or
otherwise indicated by arrows, signs
or words' that it is a driveway or
place for the leaving of such parking
lot:
Sec. 17 -3715. Use of Aisles. It shall
be unlawful for any person to travel
in the direction opposite to that
designated in one-way. shall
be unlawful for. any person to travel
on the. left side of an aisle desig-
nated for two -way traffic movement.
Sec. 17- 3716... Length of :Vehicles.
It shall be unlawful for any. person
to stop, stand. or ,.park any vehicle
having an overall length in. excess
of 21 feet in any public off- street
parking lot.
Sea 17 -3717. Trailers It shall be
unlawful for any :person to stop,
stand or 'park any house or :truck
trailer in any public off - street park -
ing lot.
Sec. 17 -3718. Speed of Vehicles. It
shall be unlawful for. any person . to
move any vehicle on any public off-
street parking lot at any speed ex-
ceeding ten (10) miles per hour.
Sea. 17 -3719. Citations. For any vi-
olation of any provision. of this or-
dinance, the 'Police Department of
the City City of Alameda is hereby ern-
powered to issue notices to appear
or citations in the usual form, and
manner 'as provided 'in. the Vehicle
Code of the State of California.
See, 17 -3720. Removal of Vehicles.
The Police Department of the City
Of Alameda is hereby empowered to
remove, or. cause to have .removed: to

safety, or to a garage designated or
maintained by the :City. of Alameda;
any vehicle that is stopped, standing
or parked on. any public off- street
parking lot in violation of Sections
17 -3712, : 17. 3714 and 17 -3715 of this
ordinance, or which is left, on such
public : off- street parking lot for : a
period exceeding thirty (30) hours.
The provisions of Section 585 of the
Vehicle Code of the State of Cali-
fornia, pertaining to notice. to owner
and garage .keeper's lien, shall apply
in the event of such removal.
See. 17- 3721. Prima Facie Presump-
tion.. In any prosecution charging a
violation of any ,of the :provisions of
this ordinance governing the stop -
ping, standing or parking . of a ve-
hicle in any public off- street parking
lot, proof that the particular vehicle
described - . the complaint was
stopped, sanding or parked in vio-
lation of any provision of this ordi-
nance, together with : proof that de-
fendant named in the complaint was
at the time of such stopping, stand-
ing or parking the registered owner
of such vehicle, shall constitute in
evidence a prima facie presumption
that the registered owner of such
motor vehicle was. the person who
stopped, left standing or-parked such
motor vehicle at the point where
and for the time during which such
violation occurred,
Seca 17 -3722. Constitutionality. If
any section, subsection, sentence,
clause, or phrase of this ordinance
is for any reason held to be invalid,
such decision or decisions shall not
affect the validity of the :remaining
portions of this ordinance. The City
Council hereby declares that it would
have passed this ordinance and..each
section, subsection, sentence;; clause
and : phrase thereof, . irrespective of
the fact that one or. more :sections;
subsections, sentences, clauses or
phrases be declared invalid.
Sec. 17 -3723: Penalty. It shall be
unlawful for any person to violate
any provision or to 'fail to comply
with any of the requirements of this
ordinance. Any :person violating : any
provisions or failing to comply with
any of the . requirements of this or-
dinance shall be deemed guilty of a
misdemeanor and,. upon conviction
thereof, shall : be punished by a fine
not exceeding Five Hundred ($500.00)
Dollars, or by imprisonment not
exceeding` six (6) months; or by both
such fine and imprisonment. Each
such person shall be deemed guilty
of a separate offense for each day
during any portion of which any vio-
lation of any of the : provisions of
this ordinance is committed, contin-
ued or :permitted by such person
and shall be punishable therefor as
provided for in this :ordinance.
SECTION 2. The Council of the
City of Alameda does hereby declare
that the herein ordinance is being
enacted.in the event of great emer-
gency and necessity. The p ublic off-
street parking lots referred to herein
will commence to be utilized as such
within a period of approximately
eight (8) days, to -wit: November 16,
1956; hence, it ' is extremely urgent
and necessary that an appropriate
ordinance governing the use of Said
off - street parking lots be in existence
and effect on such date.
SECTION 3. Pursuant to Section
3 -12 of the 'Charter of the City of
Alameda City Ordinances New se's
Ordinance No. 1202
ordinance enacted in ' the event of
great emergency or necessity, it shall
be . introduced and passed at one and
the same ' meeting and shall ' become
effective immediately 'upon :passage.
