AN ORDINANCE AUTHORIZING
GRANT OF EASEMENT OVER
CERTAIN CITY OWNED <PROPER-
TY TO DOROTHY T. MAYO AND
AMERICAN TRUST COMPANY, A
CORPORATION, TRUSTEES, AND
REPEALING A PORTION OF ORDI-
NANCE NO. 1185 N. S., RELATING
TO SAID EASEMENT.
WHEREAS, the City of .Alameda
acquired certain real property from
Dorothy T. Mayo and American
Trust Company, a corporation, as
trustees under the last will and testa-
ment of Edward M. Shaw, also known
as E. M. Shaw, deceased; and
WHEREAS, it was agreed by the
City to grant to the above named
parties an easement over the real
property acquired by the City, said
easement, to be appurtenant to cer-
tain other real property retained by
the above parties;
NOW THEREFORE, BE IT OR-
DAINED BY THE COUNCIL OF THE
CITY OF ALAMEDA:
Section 1. That the City of Alameda
grant unto Dorothy T. Mayo and
American Trust Company, a corpora-
tion, as trustees under the last will
and testament of Edward M. Shaw,
also known as E. M. Shaw, deceased,
a non- exclusive easement situated
within the real property described
below, said easement to be appurte-
nant to those - premises commonly
known and described as 1430 to 1440
Park Street, City of Alameda,' County
of Alameda, State of California, said
easement to be for the purpose of
ingress and egress of . vehicles and
pedestrians to and from said premises
of 1430 to 1440 Park Street, as set out
above, said easement being ;a lane
twelve (12) feet wide follow!ng and
being within the normal traffic circu-
lation pattern of -off- street parking
facilities situated on the real property
described above as designated by the
City of Alameda, grantor.
The real property; within which the
non - exclusive easement set out above
will be situated is described <as,all
that real property situate in the City
of Alameda; County of Alameda,
State of California, as follows:
BEGINNING at the point of
intersection" of the northwestern
dine of Park Avenue with a line
drawn parallel with the south-
western line of Santa Clara Ave -
nue and distant at right angles
133.69 feet southwesterly there-
from; running thence along said
line drawn parallel with the
southwestern line of Santa Clara
Avenue northwesterly 82.42 feet;
thence parallel = with the south-
eastern line of Park Street north-
easterly 68.50 feet to a line` drawn
parallel with the southwestern
line of Santa Clara Avenue and
distant at sight angles 65.19 feet
southwesterly therefrom; thence
I with said line of Santa
Clara Avenue northwesterly 7x.68
feet to a line drawn' parallel with
the - southeastern line of -Park
Street and distant at right angles
100 ;feet southeasterly therefrom;
thence parallel with said line of
Park Street' southwesterly 55 feet;
thence parallel with said line of
Santa Clara Avenue southeasterly
5 feet; thence parallel with said
line of Park Street southwesterly
25 feet; thence parallel with said
line of Santa Clara Avenue north-
westerly 5 feet; thence parallel
with said line of -Park Street
southwesterly 75.08 feet to the
Northeastern line of a strip of
land known as and called Post
Office Court "; thence along said
line of "Post Office Court" south-
easterly 157 feet to the northwest-
ern line of Park Avenue; and
thence along the last named line
northeasterly 87.04 feet to ` the
point of beginning.
Section 2. All that portion of Ordi-
nance No. 1185 N. S. relating to a
reservation - of an easement unto
Dorothy T. Mayo and American Trust
Company, ,a corporation, as trustees
under the last will and testament of
Edward M. Shaw, also ,known as E.
M. Shaw, deceased, is hereby re-
pealed.
Section 3. The Mayor of the City
of - Alameda be, and he is hereby;
authorized and directed to execute,
on behalf of the City, a deed trans-
ferring the easement set out above
to Dorothy T. Mayo and American
Trust Company, a corporation, as
trustees under the last will and testa-
ment of Edward M. Shaw, also known
as E. M. Shaw, deceased.
Section' 4. This ordinance shall be
in full force and effect from and
after the expiration of thirty (30)
days i from the date of its - final
passage.
