AN ORDINANCE AUTHORIZING
GRANT OF EASEMENT OVER
CERTAIN CITY - OWNED PROP-
ERTY TO THE UNITED STATES
OF AMERICA FOR SANITARY
SEWER PURPOSES.
WHEREAS, the United States of
America intends to install a sanitary
sewer pipe line between the Alameda
Naval Air Station and the Naval
Supply Depot of the Twelfth Naval
District, Public Works Office; and
WHEREAS, such installations re-
quire the grant of an easement for
such purposes over certain City-
owned real property; and
WHEREAS, it is in the best in-
terests of the City of Alameda that
such easement be granted;
NOW THEREFORE, BE IT OR-
DAINED BY THE COUNCIL OF THE
CITY OF ALAMEDA:
Section 1. That the City of Alameda
grant unto the United States of
America an easement and right - of-
way for the installation, maintenance,
operation, repair and replacement of
a sixteen-inch (16") sewer pipe line
within a 42" galvanized steel casing
over certain City-owned real prop-
erty more particularly described as
follows:
PARCEL THREE
A strip of submerged land 30
feet wide in the City of Alameda,
County of Alameda, State of Cali-
fornia, said strip of land lying
15 feet at right angles on each
side of the following described
center line:
BEGINNING at I point in the
Alameda Pierhead/ Bulkhead line
extending between Harbor Line
Points No. 51 and 53, as said line
was established by the Secretary
of the Army on 28 June, 1948 and
shown on drawing on file in the
Office of the District Engineer,
San Francisco, California, en
titled, "San Francisco Bay, Cali-
fornia, HARBOR LINES, Oak-
land- Alameda, dated 13 Febru-
ary, 1948, being Sheet No. 5 of
8 'sheets of Drawing No. 1-14-19,
said line being also the Alameda
Pierhead Line extending between
Harbor Line Points No. 51 and
53 as said line was established by
the Secretary of War on March
31, 1941 and shown on drawing
on file in the Office of the Dis-
trict Engineer, San Francisco,
California, entitled, "HARBOR
LINES, SAN FRANCISCO BAY,
CALIFORNIA, OAKLAND-ALA-
MEDA," dated September 19,
1940, being Sheet No. 5 of 8 sheets
of Drawing No, 1-14-15, and said
line being also the portion of the
northerly boundary of that cer-
tain tract of land acquired by the
United States of America (desig-
nated as "Tract 2"), by Civil
Action No. 22463-S, had in the
District Court of the United
States in and for the Northern
District of California, Southern
Division, entitled "UNITED
STATES OF AMERICA, Plaintiff,
vs. 69.448 acres of land, more o�
less, in the City of Alameda,
County of Alameda, State of Cali-
fornin CTTV OF ALAMEDA. Pit
as "South 73' 56' 44" East, 6084.97
feet" in the Judgment on Dec-
laration of Taking in said Civil
Action No. 22463-A rendered on
January 29, 1943, said Point of
Beginning being distant North
72' 49' 46" West, 965.68 feet along
the aforesaid Alameda Pierhead/
Bulkhead Line (1948) from Harbor
Line Point No. 53, the California
Coordinate System Zone III co-
ordinates of the Point of Begin-
ning are Y- 475,874.90- X- 1,476,-
507.22, and all bearings used here-
in are referenced to the merid-
ian of said California Coordinate
System, Zone III, from said
POINT OF BEGINNING thence
North 7' 10' East, 397.46 feet to
a point of terminus in the boun-
dary line between the City of
Alameda and the City of Oakland,
said boundary being assumed to
be a straight line extending from
the mid -point between Harbor
Line Points No. 54 and 51 to the
mid-point between Harbor Line
Points No. 53 and 53, the coor-
dinates of said Point of Terminus
being Y-476,239.88 - X-1,476,653.11,
The southwesterly terminus of
said strip of land being a por-
tion of the aforesaid northerly
boundary of lands of the United
States of America, (Naval Air
Station), and the northeasterly
terminus being a portion of the
aforesaid boundary line between
the City of Alameda and the City
of Oakland; containing in said
strip of land 0 274 acres, more or
less. All as shown on that certain
drawing entitled, "District Pub-
lic Works Office, Twelfth Naval
District, Naval Air Station, Ala-
meda, California, Sewage Disposal
Facilities, RIGHTS OF WAY RE-
QUIRED," DPWO Drawing No.
C-46031, attached hereto and
made a part hereof.
Section 2. The Mayor of the City
of Alameda be, and he is hereby,
authorized and directed to execute,
on behalf of the City of Alameda, a
deed transferring the easement set
out above, to the United States of
America, and the City Clerk of the
City of Alameda is hereby authorized
and directed to attest to same.
Section 3. This ordinance shall be
in full force and effect from and
after the expiration of thirty (30)
days from the date of its final pas-
