Ordinance 1235Alameda City Ordinances Ordinance No. 1235 New Series ORDINANCE NO. 1235 New Series AN ORDINANCE AUTHORIZING THE CONVEYANCE BY QUITCLAIM DEED OF ANY RIGHT, TITLE AND INTEREST THAT MAY BE HELD BY THE CITY OF ALAMEDA TO CER- TAIN ELECTRIC POWER AND LIGHT POLE EASEMENTS TO THE ALASKA PACKERS ASSOCIATION, A CALIFORNIA CORPORATION (NORTH END OF PARU STREET). WHEREAS, on September 2, 1938, the Alaska Packers Association grant- ed to the City of Alameda a revocable permit to place and maintain certain electric power and light poles with necessary wire., and fixtures upon certain real property at the north end of Paru Street owned by Alaska Pack- ers Association; and WHEREAS, the aforementioned re- vocable permit has become a cloud upon the title of the Alaska Packers Association to certain real property owned by said Alaska Packers As- sociation; and WHEREAS, the use of said real property for the maintenance of said electric power and light poles has been abandoned by the City of Ala- meda; NOW THEREFORE, BE IT OR- DAINED BY THE COUNCIL OF THE CITY OF ALAMEDA: Section 1. That the City of Ala- meda convey by quitclaim deed to the Alaska Packers Association, a corporation duly organized and doing business under and by virtue of the laws of the State of California, any right, title and interest in and to certain property, which right, title and interest was created by or arises out of that certain agreement between Alaska Packers Association, a cor- poration, and the Department of Public Utilities of the City of Ala- mean California, dated September 2, 1938 iind of record in the office of said Department of Public Utilities of the City of Alameda, California, and which was referred to in the deed from Alaska Packers Association, dated June 6, 1951 and recorded June 29 1951 in Book 6477 of Official Rec- orils of Alameda County, California, at page 25; provided, however, that no other right, title or interest than that specifically mentioned herein is intended to be transferred or is to be transferred. Section 2, That the Mayor of the City of Alameda be, and he is hereby authorized to execute, on behalf of the City of Alameda, a quitclaim deed transferring to the Alaska Packers Association the interest of the City of Alameda set out above, and the City Clerk is hereby directed to attest to same. Section 3. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage. WILLIAM M. McCALL Presiding Officer of the Council.
