subject to the following terms and
conditions:
(a) That good and merchantable
title in fee - simple: in the said =real
property to be conveyed to the City
of Alameda be conveyed free and
clear- of all objections, liens and en-
cumbrances.
(b) That the title to said real prop-
erty to be conveyed to the City of
Alameda be evidenced, by a policy
of title insurance issued by a duly
licensed title insurance company in-
suring the title in the City of Ala-
meda pursuant to Section I (a) above.
(c) That each party hereto shall
pay; his own respective closing costs,
including' title insurance and escrow
fees; if any
Section 2. That there is hereby
appropriated from the Contingent
Fund, Account 199, the amount of
$250.00, to pay for the expenses set
out in Section -1 (c) above.
Section 3. That the Mayor of the
City of Alameda is hereby authorized
to execute the deed of the City of
Alameda, for and on behalf of the
City of Alameda, to the real property
to be conveyed by the City, of Ala -
meda, as described herein and the
City; Clerk is directed to attest to
the same.
Section 4:' This ordinance shall be
in full force and effect from and
after the expiration of thirty (30) days
from the date of its final passage.
