AN ORDINANCE AMENDING TI-
TLE XV, CHAPTER 7, ARTICLE
1, OF THE ALAMEDA MUNICI-
PAL CODE BY AMENDING SEC-
TION 15-711 THEREOF, AND
ADDING SECTION 15-716 THERE-
TO, ALL RELATING TO DUST
CONTROL,
BE IT ORDAINED BY THE
COUNCIL OF THE CITY OF ALA-
MEDA;
Section 1. That Section 15-711 of
Title XV, Chapter 7, Article 1, of the
Alameda Municipal Code is hereby
amended to read as follows:
See. 15711. Conditions Declared
Unlawful and a Nuisance. It is
unlawful for any person, firm or
corporation to maintain, conduct,
or carry on, or permit to be
maintained, conducted or carried
on, any one of the conditions
set out in this article within the
City of Alameda; the following
conditions are also hereby de-
clared to be and constitute a
nuisance and a menace to public
health and safety:
(a) The maintenance of any
barn, stable, chicken yard or
manure pile in such manner that
the same is a breeding place
for flies or liable to become
such.
(b) The burning of animal
manure rendering neighboring
premises uncomfortable and un-
fit for occupancy.
(c) The discharge of sewerage,
garbage or any other organic
filth into or upon any place in
such a manner that transmission
of infective material to human
beings may result therefrom,
(d) The persistent maintenance
or emission of any noise or
sound produced by an animal or
animals which, by reason of its
raucous or nerve - racking na-
ture, shall disturb the peace or
comfort or be injurious to the
health of any person or persons.
(e) The maintenance of any
real or personal property, wheth-
er improved or unimproved, in
such a manner that dust, sand or
any other foreign material shall
be caused to be blown into the
atmosphere or spread or drift
upon property or premises of
any other person, firm or cor-
poration, in such a manner as to
be a detriment to the public
health and safety and/or the
property of such others.
Section 2. That Title XV, Chap-
ter 7, Article 1, of the Alameda Mu-
nicipal Code is hereby amended by
adding thereto Section 15-716, which
shall read as follows:
See. 15-716. Enforcement. Noth-
ing contained within this article
shall abrogate or deny the impo-
sition of the penalties contained
within Section 1-411 of this Code
for violation of the provisions of
this article. The remedies and
penalties provided in this article
and in Section 1-411 may be im-
posed cumulatively, concurrently,
or in the alternative.
Section 3. This ordinance shall be
in full force and effect from and
after the expiration of thirty (3(l)
days from the date of its final pas-
