AN ORDINANCE AUTHORIZING
THE ACQUISITION OF CERTAIN
REAL PROPERTY FOR STREET,
HIGHWAY AND GENERAL MU-
NICIPAL PURPOSES (WIDENING
OF FLOWER LANE— TARMAN).
WHEREAS, public interest and
necessity require that the real prop-
erty hereinafter described be ac-
quired by the City of Alameda for
street, highway and general munici-
pal purposes; and
WHEREAS, J. H. Turman, a mar-
ried man, is the owner of the real
property hereinafter described and
is willing to sell the same to the
City of Alameda for the sum of
NINE HUNDRED EIGHTY -FIVE and
no /100 ($985.00) - DOLLARS;
NOW THEREFORE, BE IT OR-
DAINED BY THE COUNCIL OF
THE CITY OF ALAMEDA:
Section 1. That the City of Ala-
meda purchase from J. H. Tarman,
a married man, for the sum of
$985.00, all that certain real prop-
erty situated in the City of Ala-
meda, County of Alameda, State of
California, and more particularly de-
scribed as follows:
A strip or parcel of land 10.00
feet in width, being a portion of
Lot 29, Section 19, Township 2
South, Range 3 West, Mt. Diablo
Base and Meridian, situate in said
City of Alameda and further de-
scribed to -wit*
COMMENCING at the Southeast-
erly corner of Lot 28, Section 19,
Township 2 South, Range 3 West,
Mt. Diablo Base and Meridian, as
per map entitled "Sale Map No.
10 of Salt Marsh and Tide Land,"
recorded in Book 17, page 30 of
Maps; in the office of the Recorder
of said Alameda County; said cor-
ner has coordinates y -- 454,677.33
feet and x- 1,498,352.87 feet based
on the California Coordinate Sys -
tem, Zone III, as are all bearings,
distances and coordinates in this
description; said corner bears
North 70° 37' 39" West 18.21 n
feet from United States Coast and
Geodetic Survey Station < "Mait
Flow "; thence along the Southerly
line of Lot 29 of said Section 19
South 88° 52' 45" East 49.67 feet
to a point on the Northeasterly
line of Maitland Drive, 60 feet in
width; as described in Parcel 2 of
Deed from Mary E. Foster to the
City of Alameda recorded in Book
879, page _464 of Official Records
of said Alameda County; said point
has coordinates y — 454,676.36 feet
and x — 1,498,402.53 feet and is the
TRUE POINT OF BEGINNING;
thence Northwesterly along the
Northeasterly line of Maitland
Drive, bearing North 32° 11' 11"
West for the purpose of this de-
scription, 11.97 feet; thence along a
line which is parallel with and
10.00 feet northerly at right angles
from said Southerly line of Lot
29 South 88` 52' 45" East 131.62 feet;
thence along a line which is paral-
lel with and 110.00 feet Easterly
at right angles from the North-
easterly line of Maitland Drive
South 32 11' 11" East 11.97 feet;
thence along said Southerly line
of Lot 29 North 88 52' 45" West
131.62 feet to the TRUE POINT
OF BEGINNING.
on the following terms and condi-
tions:
(a) That good and merchantable
title in fee simple in said real prop-
erty be conveyed to the City of Ala-
meda, free and clear of all objec-
tions, liens, and encumbrances; City
and County taxes to be prorated as
of the date of the closing of this
sale.
(b) That the title of said real
property be evidenced by a policy
of title insurance issued by Land
Title Company of Alameda County,
insuring title in the City, as pro-
vided in the preceding subdivision.
(c) That upon deposit with said
title company for delivery to the
City of a good and sufficient deed
of grant conveying said property to
said City and conditioned upon the
issuance of a title insurance policy,
as aforesaid, to be approved by the
City Attorney, a warrant of the
City be drawn for $1,085.00, payable
to the order of and delivered to Land
Title Company of Alameda County,
as escrow holder, for the purpose of
effecting the consummation of said
purchase and payment of title in-
surance.
Section 2. That the sum of $1,085.00
is hereby appropriated from the
Traffic Safety Fund (Account 223.251)
to pay the purchase price of said
real property and cost of title insur-
ance policy.
Section 3. This ordinance shall be
in full force and effect from and
after the expiration of thirty (30)
days from the date of its final
passage.

I, the undersigned, hereby certify
that the foregoing Ordinance was

passed by the Council of the City
of Alameda in adjourned regular
meeting assembled on the 10th day

Freeman, Petersen, Schacht and
President McCall, (5).
NOES: None.
ABSENT: None.
