ORDINANCE No. 1294,

AN ORDINANCE AMENDING OR-
DINANCE NO. 1044, NEW SERIES,
AND ORDINANCE NO. 1269, NEW
SERIES, BY TERMINATING A
LEASE OF CERTAIN CITY PROP -
ERTY AUTHORIZED THEREBY
WHEREAS, that certain Lease au-
thorized by Ordinance No. 1044, New
Series, and Ordinance No. 1269, New
Series, and amendments to said
Lease and ordinances has been en-
tered into with the United States
of America and is known and re-
ferred to as Lease No. DA 04-203 -
eng- 1091, and by its terms and
amendments expires June 30, 1959;
and
WHEREAS, it is deemed by this
Council that the best interests of
the City of Alameda will be served
by terminating, and cancelling said
Lease, effective on the 15th day of
October, 1958; and
WHEREAS a form of Supplemental
Agreement No. 3 terminating said
Lease, has been prepared and sub-
mitted to this Council and filed with
the City Clerk of said City;
NOW THEREFORE, BE IT OR-
DAINED BY THE COUNCIL OF THE
CITY OF ALAMEDA AS FOLLOWS:
SECTION 1. That the form of Sup-
plemental Agreement No. 3 referred
to in the preamble hereof and the
terms and provisions thereof be,
and the same are hereby approved.
SECTION 2. That Ordinance No.
1044, New Series, and Ordinance No.
1269, New Series, be, and the same
are hereby amended to provide that
New Series
1 Ordinance No. 1294
the expiration date of the Lease
therein authorized shall be October
15, 1958.
SECTION 3. The Mayor of the City
of Alameda is hereby authorized and
directed to execute, and the City
C"'erk to attest, as the act and deed
of the City - of Alameda, a Supple=
mental Agreement in `the form and
c- retaining the terms and provisions
set forth in the aforesaid document;
described as Supplemental Agree-
ment No. 3.
SECTION 4. This ordinance shall be
in full force and effect from and
after the expiration of thirty (30)
days from the date of its 'final pas-
sage.
