AN ORDINANCE AUTHORIZING
THE EXECUTION OF A LEASE
BY AND BETWEEN THE CITY OF
;ALAMEDA, :ASLESSOR, AND THE
ALAMEDA SWIMMING POOL AS-
SOCIATION, AS LESSEE, OF CER-
TAIN CITY -OWNED LAND (POR-
TION OF LINCOLN PARK).
WHEREAS, ,' the Alameda Swim-
ming Pool Association, a non- profit
corporation, desires to lease from the
City of Alameda a certain portion
of city -owned property located in
the City of Alameda known as Lin-
coln Park; and
WHEREAS, a form of Lease Agree-
ment containing the covenants,
terms and conditions to be entered
into is on file in the office of the
City Clerk of the City of Alameda,
and the Council of the City of Ala-
meda is informed of the contents
thereof; and
WHEREAS, it is in the public in-
terest that said Lease Agreement be
entered into;
NOW THEREFORE, BE IT OR-
DAINED BY THE COUNCIL OF THE
CITY OF ALAMEDA as follows:
Section 1. That the form of Lease
Agreement referred to - in the pre-
amble hereof, and the terms, condi-
tions and covenants contained there-
in be, and the same are hereby ap-
proved. ,
Section 2. That it is hereby de-
clared and found that the lands so
leased to - the Alameda Swimming
Pool Association are not required
for park purposes by the City of
Alameda for the term of said Lease,
and said Lease does not constitute a

substantial interference with the use
of said park by the public.
Section 3. That the Mayor of the
City of Alameda be, and he is hereby
authorized to execute; for and on be-
half of the City of Alameda, a lease
agreement substantially in the form
and containing the terms and scondi-
tions and covenants as set out in the
lease agreement referred to in the
preamble hereof, and the City Clerk
is hereby authorized and directed to
attest to same.
Section 4. This ordinance 'shall be
in full force and effect from and
after the expiration of thirty (30)
days from the ' date of its final
passage.
