AN ORDINANCE AUTHORIZING
THE EXCHANGE OF REAL PROP-
ERTY BETWEEN THE CITY OF
ALAMEDA AND SHIZUTOSHI
TAXEDA (TILDEN WAY).
WHEREAS, public interest and
necessity require that certain real
property hereinafter described be
acquired by the City of Alameda;
and
WHEREAS, the owner of said real
property„ Shizutoshi Takeda, has
agreed to exchange said real prop-
erty for other real property owned
by the City of Alameda, hereinafter
described; and
WHEREAS, the values of the re-
spective pcxcel.s of real property are
equal;
NOW THEREFORE, BE IT OR-
DAINED BY THE COUNCIL OF
THE CITY OF ALAMEDA:
Section 1. That the City of Ala-
meda accept from Shizutoshi Takeda
the transfer of that certain real
property situate in the City of Ala-
meda, County of Alameda, State of
California, more particularly de-
scribed as follows:
PORTION of the parcel of land
described in the deed to Taro
Takeda and Mildred F. Takeda,
his wife, dated February 1.2, 1954,
recorded February 19, 1954, . in
Boo'_, 7253 of Official Records of
Alameda County, page 251, (AJ-
14234) described as follows:
BEGINNING at the intersec-
tion of the northern line of the
right of way, 50 feet wide, of the
San Francisco and Alameda Rail-
road Company, now the Central
Pacific Railway Company, with
the northwestern line of the par-
cel of land above referred to;
running thence along the last
named line north, 34° 22' 42" east,
2.44 feet to a paint from which
the center of a circle with a
radius of 619.13 feet bears north
4 26' 57" west; thence along the
are of said circle easterly, 49.54
feet; thence tangent to the last
named course north 80° 58' east,
48.68 feet to the southeastern line
of the parcel of land above re-
ferred to; thence along the last
named line south 34° 22' 57" west,
15.17 feet to said northern line
of the Central Pacific Railway
Company; and thence along the
last named line westerly, 90.69
feet, to the point of beginning.
The bearings and distances
used in the above description are
based on the California Coordi-
nate System, Zone 3;
and that, in consideration therefor,
the City of Alameda transfer to the
aforesaid Shizutoshi Takeda, a single
man, that certain real property
owned by the City of Alameda,
situated in the City of Alameda,
County of Alameda, State of Cali-
fornia, more particularly described
as follows:
BEGINNING at the east corner
of that parcel of land described
in deed from Yaneo Tashiro and
Toshiko Tashiro to Taro Takeda
and Mildred F. Takeda recorded

at page 251 in Book 7253 of Offi-
cial Records of Alameda County,
said corner having t he coordi-
nates of y-- 465,921.83 feet and
x 1,497,751.36 feet based on the
California Coordinate System,
Zone 111, as are all bearings, dis-
tances, and coordinates in this
description;
THENCE South 55° 51' 43" East
61.20 feet to the north line of
Tilden Way, 70.00 feet wide;
THENCE along said north line
South 80° 58' 00" West 84.25 feet
to the southeasterly line of said
parcel;
THENCE along said southeast-
erly Line North 34 22' 57" East
57.64 feet to the BEGINNING.
Said exchange shall be subject to
the following terms and conditions:
(a) That good and merchantable
title in fee simple in the said real
property to be conveyed to the City
of Alameda be conveyed free and
clear of all objections, liens and en-
cumbrances.
(b) That the title to said real prop-
erty conveyed to the City of Ala-
meda be evidenced by a policy of
title insurance issued by California
Pacific Title Insurance Company in-
suring title in the City of Alameda
pursuant to Section 1(a) above.
(c) That each party hereto shall
pay his own respective title insur-
ance costs.
Section 2. That there is hereby
appropriated from the Special Gas
Tax Street Improvement Fund, Ac-
count 222, an amount sufficient to
pay for the costs set out in Section
lie) above, in addition to any other
incidental closing costs or escrow
fees.
Section 3. That the Mayor of the
City of Alameda is hereby authorized
to execute the deed of the City of
Alameda, for and on behalf of the
City of Alameda, to the real prop-
erty to be conveyed by the City of
Alameda as described herein, and
the City Clerk is directed to attest
the same.
Section 4. This ordinance shall be
in full force and effect from and
after the expiration of thirty (30)
days from the date of its final
passage.
