AN ORDINANCE AUTHORIZING
THE ACQUISITION OF CERTAIN
REAL PROPERTY FOR STREET,
HIGHWAY, SEWER AND GEN-
ERAL MUNICIPAL PURPOSES
(PORTIONS OF 1633 EVERETT ST.,
—TUCKER —WIDENING OF TIL-
DEN WAY).
WHEREAS, public interest and
necessity require that the real prop-
erty hereinafter described be ac-
quired by the City of Alameda for
street, highway, sewer and general
municipal purposes; and
WHEREAS, Mack Tucker and
Dollie Tucker, his wife, are the own-
ers of the real property -hereinafter
described and are willing to grant
the same to the City of Alameda for
the sum of $2,000.00;
NOW THEREFORE, BE IT OR-
DAINED BY THE COUNCIL OF THE
CITY OF' ALAMEDA:
Section 1. That the City of Ala-
meda purchase, for the sum of
$2,000.00, that certain real Property
situated in the City of Alameda,
County of Alameda, State of Cali-
fornia, more particularly described
as follows:
BEGINNING at the intersec-
tion of the northwesterly line of
Everett Street, 60.00 feet wide,
with the southwesterly line of
the parcel of land described in
the deed from Henry Zilke,
of ux., to Mack Tucker, et ux.,
dated February 6, 1947, recorded
February 18, 1947, at page 139 in
Book 5092 of Official Records of
Alameda County
THENCE North 55' 51' 43" West
24.85 feet (based on the Califor-
nia Coordinate System, Zone III,
as are all hearings and distances
in this description);
THENCE North 80' 58' 00" East
34.21 feet to said northwesterly
line of Everett Street;
THENCE along last said line
South 34 23' 18" West 23,41 feet
to the BEGINNING,
on the following terms and condi-
tions:
(a) That good and merchantable
title in fee simple in said real prop-
erty be conveyed to the City of
Alameda, free and clear of all ob-
jections ' liens and encumbrances.
(b) That the title of said real prop-
erty be evidenced by a policy of title
insurance, insuring title in the City,
as provided in the preceding sub-
division.
(c) That upon deposit with the title
company for delivery to the City of
a good and sufficient deed of grant
conveying said property to said City,
and conditioned upon the issuance
of a title insurance policy as afore-
said, to be approved by the City
Attorney, a warrant of the City be
drawn for $2,000.00, payable to the
order of said title insurance company
as escrow holder, for the purpose of
effecting the consummation of said
transaction
Section 2. That the sum of $2,000.00,
together with a sum sufficient to
cover cost of title insurance and
other expenses incidental to said
transaction is hereby appropriated
from the Special Gas Tax Street Im-
provement Fund (Account 222) to
pay the purchase price of said real
property, cost of said title insurance
policy, and incidental expenses.
Section 3. This ordinance shall be
in full force and effect from and
after the expiration of thirty (30)
days from the date of its final
passage.

I, the undersigned, hereby certify
that the foregoing Ordinance was
duly and regularly adopted and
passed by the Council of the City of
Alameda in regular meeting assem-
bled on the 2nd day of May, 1961, by

frey, McCall, Schacht and President
Colliselionn, (5).
