Ordinance 1390ORDINANCE NO. 1390 AN ORDINANCE OF THE CITY OF ALAMEDA AUTHORIZING THE EXECUTION OF CERTAIN LEASES BY AND BETWEEN THE CITY OF ALAMEDA, AS LESSEE AND OTHER PERSONS AS LESSORS, RELATING TO BLAST AND /OR FALL - OUT SHELTERS (EMER- GENCY ORDINANCE), WHEREAS, the threat of nuclear war is a present, and existing danger; and WHEREAS, it is in the public in- terest that protective structures and devices against the dangers of such catastrophe be constructed by resi- dents and property owners of the City of Alameda; and WHEREAS, it is in the public interest that leasing agreements be entered into with such property own- ers as lessors, relating to the blast and /or fall -out shelters so con- structed; and WHEREAS, a form of lease agree- ment is on file in the office of the City Clerk of the City of Alameda, marked "Filed, Cot. 3, 1961," and the Council is informed and aware of the contents of such lease agreement, NOW THEREFORE, BE IT OR- DAINED BY THE COUNCIL OF THE CITY OF ALAMEDA: Section 1. That the City Manager of the City of Alameda be and is hereby authorized to execute for and on behalf of the City of Alameda, as Lessee, a leasing agreement with residents and /or property owners, as Lessors, re- lating to real property located within the City of Alameda, upon which blast and /or fall -out shel- ters are constructed, substantially in the form and with similar terms, conditions and covenants as contained in that certain leas- ing agreement on file in the office of the City Clerk of the City of Alameda, marked "Filed Oct. 3, 1961." The City Clerk is hereby directed to attest to same. Section 2. That the annual rental paid by the City of Alameda under such leasing agreements shall not exceed the amount of four ($4.00) dollars per each per - son for which such shelter may be capable of protecting from nuclear blast or fall -out dangers as certified by tile City Engineer of the City of Alameda. Section 3. That this ordinance is hereby declared to be an ordi- nance enacted in great urgency and necessity for the preservation of the public peace, health, and safety. This declaration is based upon the fact, that the City of Alameda is immediately threaten- ed with the dangers of a nuclear war and that for the preserva- tion of the public peace, health, and safety it is necessary to en- courage the construction by pri- vate citizens of nuclear blast and /or fail -out shelters, and in the event there be excess capa- city in such shelters to provide for its use by other persons in the event of great emergency or disaster. Section 4, This ordinance being en- acted for the immediate preser- vation of the public peace, health and safety is being introduced and passed at one and the same meeting and shall become effec- tive immediately.
