AN ORDINANCE AUTHORIZING
ACQUISITION BY PURCHASE OF
CERTAIN REAL PROPERTY FOR
CITY PUBLIC UTILITY PURPOSES. (2.95 ACRES PACIFIC
SHOPS, INC.)
WHEREAS, public interest and
necessity require the real property
hereinafter described be acquired
in the name of the City of Alameda
for use by its Bureau of Electricity
as the location of said Bureau's
Operating Department Headquar-
ters; and
WHEREAS, Pacific Shops, Inc.,
owner of said property which con-
sists of approximately .2.35 acres,
is willing to sell the same to the
City far the sum of $23,000.00 per
acre, upon certain conditions here-
tofore tentatively agreed upon be-
tween •said owner and said Bureau;
and
WHEREAS, pursuant to Article
X.II of the Charter of the City of
Alameda, the Public Utilities Board
has the power, among other things,
to control and manage the said
Bureau of .Electricity, a public util-
ity =owned by the - City, and to - �ac-
quire by purchase in the . name of
the City real property necessary
for its purposes; and
WHEREAS, said Pacific Shops,
Inc. is the successor lessee of ap-
proximately 13.5" acres . of City-
owned lands adjavenFt to other real
property owned: by Pacific Shops,
Inc., and said firm : desires to re-
negotiate said lease by providing ;a
new term therefor at an increased
annual rental; and
WHEREAS; it will be in the pub-
lic interest and to the mutual bene-
fit of said parties to . enter into
said new lease, in connection with
and as -a condition of the said
acquisition of property by the City;
NOW THEREFORE,. BE IT. OR-
DAINED BY THE C'OUNC'IL OF
THE CITY OF ALAMEDA:
SECTION 1. That the Public Utilities
Board purchas , in the name of. the
City °cif Alameda; 'upon the condi-
tions hereinafter , set forth, for the
sum, of $54,050:00 that certain real
property situated in. the City of
Alameda, C'ounty Alameda, State
of California described as follows:

(c) -That good and merchantable

property be ,conveyed to the City
of Alameda, free and clear of all
objections, liens and encumbrances.
(d) That the said title of said
real property be evidenced by a
California standard policy of title
insurance, issued by Title Insurance
& . 'Trust Company,' under : its Es-
crow Nei. 1119697, AT -3, insuring
title. in the City, as provided for
in the preceding subdivision.
