AN ORDINANCE AUTHORIZING
CONVEYANCE, BY QUITCLAIM
DEED AND UPON CONDITION,
OF CEATAiN SURPLUS CITY -
OWNED REAL PROPERTY TO
GENE A. STAUBER (.162 ACRES,
BEACH ROAD NEAR FITCH-
BURG AVENUE)
WHEREAS, the City of Ala-
meda is the owner of the certain
hereinafter described real prop-
erty which adjoins a larger par-
cel owned by the proposed
grantee herein and if combined
therewith would comprise an area
which will provide three lots of
approximately 110 feet by 50 feet
each- and
WHEREAS, said property is not
required for municipal purposes
and it would be in the public in-
terest to convey same to said
adjoining owner, by quitclaim
deed, upon condition that the said
combined area be subdivided and
certain improvements be made
thereupon; and
WHEREAS, Gene A. Stauber
has offered to pay the City the
sum of Four Thousand, Five Hun-
dred ($4,500.00) Dollars for a con-
veyance by quitclaim deed of said
property, which is subject to the
easement and conditions con-
tained in that certain agreement
dated June 13, 1950, between the
City of Alameda and the City of
Oakland, recorded October 3, 1950,
in the office of the County Re-
corder of Alameda County in
Book 6245, page 293;
NOW THEREFORE, BE IT OR-
DAINED BY THE COUNCIL OF
THE CITY OF ALAMEDA :
Section 1. That the City of Ala-
meda transfer by quitclaim deed
unto Gene A. Stauber all that
certain real property situate in
the City of Alameda, County of
Alameda, State of California,

follows:
PORTION of Lot 15, in _Sec-
tion 30, Township 2 South,
Range 3 West, Mount Diablo
Base and Meridian, as said lot
is shown on "Sale Map No. 10
of the Salt Marsh and Tide
Lands, situate in the County of
Alameda," etc., filed June 9,
1888, in Book 17 of Maps, page
30, in the office of the County
Recorder of Alameda County,
described as follows;
BEGINNING at the intersec-
tion of the western line of said
Lot 15, with the southwestern
line of Beach Road, 60 feet
wide; and running thence along
the last named line South 32
11' 11" East to the northwestern
line of the parcel of land de-
scribed in the Deed by the City
of Alameda to Anthony J. Ber-
tero, dated July 19, 1960, re-
corded October 19, 1960, on Reel
189, Image 685, (AR- 123416) Ala-
meda County Records; thence
along the last named line South
57° 43' 49" West to the western
line of zniri TM 15, and thPnrp
for and in consideration of the
sum of $4,500.00 to be paid in
cash to the City of Alameda by
Gene A. Stauber -coincident with
the tender of a quitclaim deed,
containing the conditions set
forth in Section 2 hereof, convey-
ing said real property. All escrow,
title insurance and other charges
shall be paid by grantee.
Section 2. That said conveyance
shall contain the condition that,
within one year, or upon an ex-
tension thereof granted by City
of a further period not to exceed
six months, after delivery of said
conveyance, grantee or her as-
signees shall (1) make formal ap-
plication to City for a .subdivision
of the larger parcel formed by
acquisition of the herein con-
veyed property and the adjoining
property now owned by grantee,
and (2) cause to be made upon
said property certain street, curb,
sidewalk, grading and utility im-
provements, all to the satisfaction
of the City. Said conveyance shall
also provide for reversion to
City of said property in the event
there shall be a breach of said
conditions. Upon such reversion,
and the valid reversing of title
to said property in the City of
Alameda, said grantee or her as-
signees shall become entitled to
repayment of the consideration
mentioned in Section 1 hereof.
In the event said conditions
shall have been fully performed
in the manner and within the
time hereinabove set forth, then
City shall, under authority of this
ordinance, execute and deliver to
grantee or her assignees a fur-
ther deed quitclaiming =City's re-
maining interest of record in said
property.
Section 3. That the Mayor of
the City of Alameda is hereby
authorized to execute, and the
City Clerk to .attest, a quitclaim
deed transferring the hereinbe-
fore described real property to
Gene A. Stauber.
Section 4. This ordinance shall
be in full force and effect from
and after the expiration of thirty
(30) days from the date of its
final passage.

I, the undersigned, hereby cer-

and passed by the Council of the
City of Alameda in regular meet-
ing assembled on the 19th day of
April, 1966, by the following vote,
to wit:

Croix, Jr., McCall, Rose and
President Godfrey, (5).
NOES: None.
