Ordinance 1538ORDINANCE 1538 AN ORDINANCE AUTHORIZING PURCHASE OF REAL PROPERTY (FIREHOUSE SITE NORTHEAST CORNER PARK STREET- ENC'INAL AVENUE) WHEREAS, pursuant to au- thorization by its City Council, option agreements for sale and purchase of the herembeiow de- scribed real property have been entered into by and between the City and the respective owners of said property; and WHEREAS, it is in the best public interest that the City ex- ercise the option or right to pur- chase granted in said agreement, and acquire ownership of said property, for use thereof as the site of a new firehouse to replace the Fire Station presently located on Webb Avenue; and WHEREAS, the said owners are willing to sell said real property to the City for the price and up- on the terms and conditions con- tained in the option agreements referred to above; NOW THEREFORE, BE IT OR- DAINED BY THE COUNCIL OF THE CITY OF ALAMEDA: Seciion 1„ That the City of Ala- meda purchase from Alameda Amusement Company, a Cali- fornia corporation, for the sum of ONE HUNDRED FIVE THOU - SANT) and N01100 ($105;000.00) DOLLARS, and in the manner and upon all the terms and con- ditions of the agreement executed August 26, 1966, between said corporation and the City of Ala- meda, that certain real property situated in the City of Alameda, County of Alameda. State of Cali - fornia, particularly described as follows: PARCEL 1, BEGINNING at a point on the southeasterly line of 'Park Street as widened to 80.00 feet, distant along said Pane 571.54 feet southwesterly from the southwesterly Iine of Cen- tral Avenue as widened to 80.00 feet, said point being on the southwesterly line of Lot D, Block 6 as said Lot and Bloc] are shown on the map entitled "Alameda Park Homestead" filed May 30, 1874 at Page 32, Book 17 of Maps, Official Records of Alameda county; linty; THENCE northeasterly a I o n g said southeasterly line 120.00 feet to a line parallel with and 20.00 feet northeasterly, at right angles, from the southwesterly line of Lot D, Block 5, as shown on said map; THENCE southeasterly along said parallel line 145.23 feet to the southeasterly line of said Lot D, Block 5; THPNO southwesterly along the last said line 10.00 feet; THENCE southeasterly along a line parallel with the said ;southwesterly line of Lot D 20.0? feet to a line drawn parallel with and 20 feet southeasterly, at right angles, from said southeasterly line of Lot .L`; THENCE southwesterly along that last said parallel .line 110.00 feet to the southwest- erly line of Block 6, as shown on scud map; THENCE northwesterly along the last named line 165.46 feet to the POINT OF BEGIN- NING. PARCEL 2. A RIGHT OF WAY FOR in- gress and egress over that cer- tain piece or parcel of land more particularly described as follows: BEGINNING at a point on the northwestern line of Park Avenue, distant thereon northeasterly 10 feet from the point of intersection thereof with the southwestern bound- ary line of Lot "B" in Block 6, as said Avenue, Lot and Block are shown on the "Map of Alameda Park Homestead," hereinafter referred to; run- ning t h e n c e southwesterly along said line of Park Ave- nue 10 feet; THENCE northwesterly along said southwesterly boundary line of Lot "B" 134.56 feet; THENCE northeasterly parallel with the southeastern line of Park Street 17 feet; THENCE southerly in a direct line 9.90 feet to a point dis- tant 127.56 feet westerly from the POINT OF BEGINNING, pleasured along a line parallel with said southwestern boundary line of Lot 'B "; THENCE southeasterly along the line so drawn 127.56 feet to the POINT OF BEGIN- NING. A portion of Lot "B" in Block 6, as said Lot and Block are shown on the "Map of Ala- meda Park Homestead ", filed May 30, 1874, in Book 17 of Maps, Page 32, in the Office of the County Recorder of Alameda County. Section 2. That the City of Alameda purchase from Martha Anita Jenkins and Sara Wanda Brooks, vestees of an undivided two- thirds interest, and Grace Ann Smith, vestee of an undivid- ed one -third interest, for the sum of EIGHTY -FOUR THOU AND and NO /100 ($84,000,00) DOL- Alameda Clity Ordinances Ordinance No. 15 New S�ries I LABS, and in the mariner and upon all the terms and conditions of the agreement executed July 29, 1966, between said persons and the City of Alameda, that certain real property situated in the City o Alameda, County of Alameda, State of California, particularly described as follows: BEGINNING at a point on the southeasterly line of Park Street as widened to 80.00 feet, distant along said line 571.54 feet southwesterly from the southwesterly line of Cen- tral Avenue as widened to 90-00 feet, said point being on the northeasterly line of Block 7 as said block is shown on the map entitled "Alameda Park Homestead" filed May 30, 1874 at Page 32, Book 17 of Maps, Official Records of Ala- meda County; THENCE southeasterly along said northeasterly line 125.92 feet to a line parallel with and 125.92 feet southeasterly, at right angles, from said southeasterly line of Park Street; THENCE southwesterly along the last said parallel line 83.56 feet to the northeasterly line on Encinal Avenue as said avenue now exists; THENCE northwesterly along the last said line to said south- easterly line of Park Street; THENCE northeasterly along the last said line 80.00 feet more or less to the BEGIN- NING Section 3. That upon perform- ance of the terms and conditions contained in the two option agreements referred to in the preceding sections, and upon de- posit, in escrows numbered (a) OK-112627, A-185(41), and (b) OK- 112 A-185 (48 and 49), respectively, heretofore estab- lished with Title Insurance and Trust Company, Oakland office, for delivery to the Clty of good and sufficient deeds of grant, from each of the owners named in Sections I and 2 herein, convey- ing said described properties to said City, and conditioned upon issuance of land title insurance policies by said Title Company, all as provided for in said option agreements, checks of the City be drawn for the sums of $105,000,00 and $84,000.00, respectively, pay- able to the order of said title in- surance company, as escrow hold- er, for the purpose of effecting consummation of said acquisi- tions. Section 4. That the sums of $105,000.00 and $84,000.00, respec- tively, together with a sum suf- ficient to cover cost of title in- surance and other incidental ex- penses of said acquisition be ap- propriated from the Capital Out- lay Fund (Account 225,30) to pay the purchase price of said real property, cost of said title insur- ance and incidental expenses. Section 5. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage. WILLIAM S.
