APPROVING AND AUTHORIZ-
ING EXECUTION OF AMEND-
MENT TO AGREEMENT GRANT-
ING DEVELOPMENT RIGHTS
TO CERTAIN CITY OWNED
TIDE AND SUBMERGED LANDS
WHEREAS, pursuant to Ordi-
nance No. 1465 N.S., passed Sune
3, 1861, the City granted to Bern-
hard & Associates an exclusive
license, right and privilege to
certain salt marsh, tide and sub-
merged lands owned by the City,
for the purposes of filling, im-
proving, developing, operating
and leasing said lands, and on
October 6, 1964, entered into an
agreement with said Bernhard &
Associates therefor; and
WHEREAS, by its Resolution
No. 7171, adopted July 18, 1967,
the City consented to the assign-
ment of said agreement from
said Bernhard & Associates to
Pan- Pacific Development Com-
pany, a California corporation, in
the manner provided for in Part
III, paragraph (1) of said agree-
ment; and
WHEREAS, said Pan - Pacific De-
velopment Company has under-
taken performance of said agree-
ment in full accord with the
tenor and intent thereof, and it is
now in the best public interest
that an amendment thereto, to
be denominated "Master Lease,"
be entered into between the City
and said Company;
NOW, THEREFORE, BE IT OR-
DAINED BY THE COUNCIL OF
THE CITY OF ALAMEDA:
Section 1. That the amendment
to that certain agreement, author-
ized on June 3, 1964, by Ordi-
nance No.' 1465 N.S.; in substan-
tially the form of that written
instrument denominated Master
Lease, heretofore filed with the
City Clerk on February 20, 1968,
between the City of Alameda and
Pan - Pacific Development Com.
pany, a California corporation,
is hereby approved, and the pur-
poses of said agreement and said
amendment, and the rights there-
in granted, shall be carried out
and effected strictly in accord-
ance with each and all of the
terms, conditions, covenants and
agreements contained in said .in-
struments.
Section 2. The Mayor of the
City of Alameda is hereby author-
ized to execute the aforesaid
Master Lease on behalf of said
City and the City Clerk is hereby
directed to attest to the same,
when this ordinance shall become
effective.
Section 3. The real property
referred to in said agreement and
in the amendment herein ap-
proved, is more particularly de-
scribed as follows:
A parcel of land situated in
the City of Alameda, County
of Alameda, State of Califor-
nia, and further described as
follows:
BEGINNING at the south-
easterly corner of Lot 31,
Section 10, Township 2 South,
Range 4 West, Mount Diablo
Base and Meridian, as said
Lot is shown on "Map No. 2
of Salt Marsh and Tide Lands
Situate in the County of Ala-
meda, State of California,
1871 ", prepared by order , of
the Board of Tide Land Com-
missioners and filed in the of-
fice of said Commissioners in
San Francisco, certified copies
thereof having been filed
with the County Recorder of
the City and County of San
Francisco and in the Office
of the Surveyor General of
the State of California (now
the office of Department of
Finance, Division of State
Lands), said corner having
coordinates of y_966,225.06
feet and _x= 1,484,685.12 feet
based on the California Co-
ordinate System, Zone III, as
are all bearings and distances
in this description;
THENCE along the line of
the Alameda Basin as said
line is located by and listed
in Field Notes of Map No. 2,
G. F. Allardt's Survey of Salt
Marsh and Tide Lands, and
is shown on the aforesaid
Map No. 2 of Salt Marsh and
Tide Lands, South 63° 48' 58"
East 500 00 feet:
THENCE South 1° 05' 26"
West 1300.48 feet to the
United States Bulkhead Line
of 1948 between Stations 155
and 157 thereof;
THENCE along said United
States Bulkhead Line North
63° 4-4' 23" West 2512.21. feet
to its intersection with a line
drawn southwesterly perpen-
dicular to said Alameda Basin
Line from the southwesterly
corner of Lot 19 in Section 10,
Township 2 South, Range 4
West, Mount Diablo Base and
Meridian, as said Lot 19 is,
shown on the aforesaid Map
No. 2 of Salt Marsh and Tide
Lands;
THENCE along said perpen-
dicular line North 26° 11' 02"
East 1174.39 feet to, said south-
westerly corner of Lot 19;
THENCE along said Ala-
meda Basin Line South 63°
48' 58" East 1460.68 feet to the
BEGINNING.
Section 4. This •ordinance shall
be in full force and effect from
and after the expiration of thirty
(30) days from the date of its
final passage.
