AUTHORIZING AMENDMENT TO
LEASE BETWEEN CITY AND
TODD :.SHIPYA'?DS ..CORPORA-
TION, SAM AMENDMENT ADD -
ING PARCEL OF SUBMERGED
LANDS TO LEASED PREMISES;
APPROVING FORM AND AU-
THORIZTNG EXECUTION OF
SAID AMENDMENT
WHEREAS, pursuant to its Or-
dinance No. 897 N.S., enacted July
16, 1946, the City leased certain
of its tide and submerged lands
to United Engineering Company,
a corporation, for a term com-
mencing September 1, 1946, and
expiring September 30, 1964, with
the option of lessee or its assigns
to renew for an additional term
of 25 years, commencing October
1, 1964, and ending September 30,
1989, said lands consisting of
12.961 acres, more or less; and
WHEREAS, said lessee, with the
City's written consent as evi-
denced by its Resolution Nos.
3705, 3939, 4985, 5293, 5770 and
5903, duly assigned said lease to
Todd Shipyards Corporation, a
corporation duly organized and
existing under the laws of the
state of New York, which is by
virtue of said assignment the
substituted lessee thereunder; and
WHEREAS, said lessee did on
February 27, 1964, exercise its
said option and right to renew
said lease for the further said
term, expiring September 30,
1989, as aforesaid, as provided in
said lease, and the City, by its
Resolution No. 6578, adopted
March 17, 1964, recognized and
approved said renewal for the
further term; and
WHEREAS, it is now deemed
mutually desirable and deter-
mined to be in the best public
interest that said lease be
amended by adding a parcel con-
sisting of approximately 4.542
acres, more or less, of City -owned
submerged lands to the demised
premises, at an additional rental
therefor, and that said lease, and
all of its other terms and condi-
tions remain unchanged; and
WHEREAS, a form of such
amendment has been prepared
and submitted to this Council at
its regular meeting of August 20,
1968, and filed in the office of the
City Clerk on said date; and
WHEREAS, this Council is fully
informed cf the contents of said
amendment, and hereby finds it
necessary and convenient for the
promotion and accommodation of
shipping and commerce that said
lease be amended by adding said
City -owned submerged lands to
premises described in said
lease;
NOW, THEREFORE, BE IT OR-
DAINED BY THE COUNCIL OF
THE CITY OF ALAMEDA that:
Section 1. The form of amend-
ment to the lease hereinabove in
the recitations referred to be and
is hereby approved.
Section 2. The parcel of sub -
merged real property described
in said amendment be leased to
Todd Shipyards Corporation, upon
the terms, conditions and pay-
ments contained in said form of
amendment, submitted and filed
as aforesaid.
Section 3. The Mayor of the
City of Alameda is authorized
and directed to execute, and the
City Clerk directed to attest to,
respectively, for and on behalf of
said City, an a®reement amending
said lease, said amendment to be
substantially in the form of that
hereinabove referred to.
Section 4. This ordinance shall
be in full force and effect from
and after the expiration of thirty
(30) days from the date of its
final passage.
