Ordinance 1581ORDINANCE 1581 AN ORDINANCE AMENDING T H E ALAMEDA MUNICIPAL CODE BY AMENDING SEC- TIONS 17 -55L 17 -552 AND 17 -553 THEREOF, PROHIBITING USE OF CERTAIN STREETS BY ANY VEHICLE EXCEEDING A MAXI- MUM GROSS WEIGHT OF THREE TONS, WITH EXCEPTIONS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that: Section 1. Sections 17 -551, 17- 552 and 17 -553 of the Alameda Municipal Code are hereby amended to read as follows: Sec. 17 -551. Vehicles Exceed- ing Stated Weight Prohibited. It shall be unlawful for the owner, operator or driver of any motor vehicle whose gross weight exceeds three (3) tons, to drive or operate, or to cause to be driven or operated, such vehicle at any time upon and along the following designated restricted public streets: (1) Ballena Boulevard, for its entire length; (2) Bayview Drive, for its en- tire length; (3) Broadway, from Otis Drive to Shore Line Drive; (4) Buena Vista Avenue, from Poggi Street to Webster Street; (5) Central Avenue, from En- cinal Avenue to East Shore Drive; (6) Clinton A v e n u e, from Grand Street to Park Street; (7) County Road, for its en- tire length; (8) East Shore Drive, from Central Avenue to Encinal Avenue; (9) Eighth Street, from Buena Vista Avenue - to Westline Drive; (10) Encinal A v e nu e, from Broadway to East Shore Drive; (11) Everett Street, for its en- tire length; (12) Fernside Boulevard, from Versailles Avenue to 100 feet south of Encinal Ave - nue; (13) Fifth Street, for its entire length; (14) Fir Avenue, for its entire length; (15) Fitchburg Avenue, fro m Maitland Drive to Mag- nolia Drive; (16) Franciscan Way, for its en- tire length; (17) Gibbons Drive, for its en- tire length; (18) Grand Street, from Buena Vista Avenue to Shore Line Drive; (19) High Street, from San Jose Avenue to Otis Drive; (20) Island Drive, for its entire length; (21) Kitty Hawk Road, from Franciscan Way to Shore Line Drive; (22) Lincoln Avenue, from Fifth Street to High Street; (23) Magnolia Drive, from Fitch- burg Avenue to 100 feet south of Oleander Avenue; (24) Maitland Drive, from Doo- little Drive to Fitchburg Avenue; (25) Marshall Way, for its en- tire length; (26) Mecartney Road, from Ver- demar Drive to Maitland Drive; (27) Melrose Avenue, from Me- cartney Road to the south end; (28) Oak Street, from Clement Avenue to San Jose Ave- nue; (29) Oleander Avenue, for its entire length; (30) Otis Drive, from Westline Drive to Park Street; (31) Pacific Avenue, from Main Street to Marshall Way; (32) Park Street, from Buena Vista Avenue to Otis Drive; (33) Poggi Street, for its entire length; (34) San Jose Avenue, f r o m Grand Street to High Street; (35) Santa Clara Avenue, from Webster Street to High Street; (36) Sherman Street, from In- dustrial Highway to En- cinal Avenue; (37) Shore Line Drive, for its entire length; (38) Singleton Avenue, for its entire length; (39) Third Street, for its en- tire length; (40) Tilden Way, from Park Street to Buena Vista Ave - nue; (41) Verdemar Drive, for its en- tire length; (42) Webster Street, north of the Tube Portal Building; (43) Westline Drive, for its en- tire length; (44) Willow Street, from En- cinal Avenue to Shore Line Drive. Sec. 17 -552. Exceptions. Com- mercial and Public Utility Ve- hicles. The provisions of Sec- tion 17 -551 shall not be eon - strued to prohibit any commer- cial vehicles coming from an unrestricted street having in- gress and egress by direct route from a restricted street when necessary for the purpose of making pickups or deliveries of goods, wares, and merchandise from or to any building or structure located on the re- stricted street or for the pur- pose of delivering materials to be used in the actual and bona fide repair, alteration, remodel- ing, or construction of any building upon the restricted street for which all building and other permits required by law have previously been ob- tained. The provisions of Sec- tion 17 -551 shall not apply to any vehicle owned by a public utility or a licensed contractor while necessarily in use in the construction, installation, or re- pair of any public utility. Sec. 17 -553. Signs to be placed. The Chief of Police shall cause appropriate signs to be erected indicating the restrictions here- in imposed in a manner which will serve to give notice thereof. Section 2. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage. Provided, however, such final passage shall not be prior to date of the public hear- ing heretofore set by Resolution No. 7386, adopted October 1, 1968, pursuant to Section 35705, Vehicle Code of California.
