AUTHORIZING AND DIRECTING
PUBLIC UTILITIES BOARD
(BUREAU OF ELECTRICITY) TOt
REDUCE DISTRIBUTION OF ELEC-
TRICAL ENERGY TO NONESSEN-
TIAL USERS TO CONSERVE
ENERGY FOR ESSENTIAL USES
(EMERGENCY MEASURE)
WHEREAS, there presently exists a
shortage of electrical energy, and
WHEREAS, the California Public
Utilities Commission hos determined in
Case No. 95BI before said Commission
that shortages are growing,.that
comprehensive conservation measures
are needed, that mandatory curtail -
ments are required, certain users
can achieve greater. reductions without
severe consequences and that if reduc-
tions are achieved by.those best able to
shoulder them, it may be possible to
sustain service where, it is most
beneficial to the economic well -being
of all; and
WHEREAS, said state Public Utili-
ties Commission has ordered utilities
under its jurisdiction to curtail the
distribution of certain non - essential
uses; and
WHEREAS, the distribution of elec-
tricnl enerav in the City of Alameda is
not governed by the rules of said Public
Utilities Commission, and
WHEREAS, this Council finds that
the same condtions pertain to the dis-
tribution of electrial energy in the City
of Alameda as pertain to the distribu-
tion of electrical energy throughout the
State of California,
NOW, THEREFORE, BE IT OR-
DAINED BY THE COUNCIL. OF THE
CITY OF AL,AMEDA: .
Section 1. That the City Public Utili-
ties Board, distributor of electrical
energy within the City by its Bureau of
Electricity, is hereby authorized and
directed to amend its rules and regula-
tions so as to curtail the distribution of
electrical energy for such uses as said
Board determines are non - essential.
Sections 2, Said Public Utilities Board
may accept, in whole or in part, the
findings - and conclusions, and
implementation thereof, of the Califor-
nia Public Utilities Commission as suf-
ficient evidence of non- essential use
and may adopt, in whole or in part, the
rules and proceclures or said Cornmis-
sian as the means of implementing this
ordinance,
Section 3. The provisions of this or-
dinance shall not be construed to limit
the powers of said Public Utilities
Board to modify its rules, regulations
and tariffs.
Section 4. This ordinance is one of
great necessity and urgency within the
rneansnq of Section 3 -12 of the City
Charter, is introduced and passed at the
some Council meeting, and shall be ef-
fective on February 19, 1974,
Section 5, The facts constituting the
necessity and urgency of this ordinance
are,
(1) Electrical shortages are im-
minent;
(2) Certain non - essential uses Have
already been curtailed in other com-
munities, and
(3) Action may be taken by said
Board's wholesale supplier to cut ser-
vice to the City of Alameda if the Public
Utilities Board does not make similar
cuts in non- essential service immedia-
tely.
