AMENDING THE ALAMEDA
MUNICIPAL CODE BY AMENDINNG,
ADDING, TO, AND REPEALING
CERTAIN SECTIONS THEREOF;
RELATING TO THE REGULATION
OF DOGS, CATS. AND OTHER
ANIMALS WITHIN THE CITY, ES-
TABLISHING FEES FOR LICENS-
ING, AND PROVIDING FOR. IM-
POUNDMENT, RETRIEVAL AND
DISPOSITION OF SAME.
BE IT ORDAINED RY THE COUN-
CIL OF THE CITY OF ALAMEDA:
Section 1. Sections 2- 482; 2 -484 and
2 -485 of the Alameda Municipal Code
are amended to read:
Sec. 2-482. uuty To Notify Owner Of
Impounding. The Poundmaster shall
immediately, upon the impound-
ment of any animal, make every
reasonable effort to notify the owner
of such animal impounded, and in-
form such owner of the conditions
whereby they may regain custody of
such animal. Such notice shall be
either personal, or by telephone
communication, or by deposit in the
mails properly addressed and pos.
tage prepaid.
Sec. 2 -484. Office Hours. The
Poundmaster or his duly authorized
deputy shall attend at the public
pound Monday through Friday -from
8 a.m. to 5 P.M. and on Saturday
from 8 a.m. to 2 p.m., during which
time the pound shall be open to the
transaction of all business pertain-
ing thereto, with the exception of
those times it is required to patrol
and transact required business away
from the pound. The Poundmaster
and the public pound shall be subject
to the direction and supervision of
The City manager and the City En-
gineer.
Sec. 2 -485. Monthly Reports. The
Poundmaster shall make a true and
correct report each month, of the
number of dogs and other animals
impounded by him during the
Preceding month and of the disposi-
tion made of them and of the amount
of money received.
Section 2, Section 2 -522 of the
Alameda Municipal Code is amended
to read:
Sec. 2-522. Fees To Be Charged By
Poundmaster. The Poundmaster
shall charge the fees hereinafter set
forth in connection with the im-
pounding and feeding, caring and
removal of animals:
Imnoundina
(a) For every dog, the sum of .. S 6.00
(b) For every cat, the sum of.... 3.00
(c)For every horse, mule, ass, bull, ox,
cow or calf, pony, the sum of.... 20.00
(d) For every other animal not other-
wise provided for in this ordinance, the
estimated cost of this service.
(e) Second impounding of same animal
within 12 months period, said fees shall
be doubled.
Feeding /Caring
(a) For each dog, per day ....... $ 1.50
(b) For each cat, per day......... 0.75
(c) For each horse, mule, ass, quit, ox,
cow or calf, pony, per day.. 4.00
(d) For each other animal not other
wise provided for in this ordinance, the
estimated cost for this service.
Removal from Private Property
(a) For each dog, cat or other small
type of animal, the sum of....... S 2.00
(b) For each horse, mule, ass, bull, ox,
cow.or calf; pony, the sum of .... S 5.00
Section 3. Sections.4 -132; 4 -133, 4 -134
and 4.137 of the Alameda Municipal
Code are amended to read:
Sec, 4.132, Record Of Impounded
Animals: The Poundmoster shall
keep a true and faithful record of
the number and description of all
animals taken into his custody, with
the date.of their receipt and the date
and manner of their disposal, with
the fees and charges collected on
account of said animals, and the
disposition thereof. Said record to
be kept by the Poundmoster on
approved forms, which shall be the
record of the office of the Pound -
master. He shall also provide
necessary subsistence for all
animals while in his custody.
Sec. 4.133. Right-To Sell. The
Poundmaster shall have the
authority to sell all animals if not
reclaimed within three working
days after impoundment thereof.
Sec. 4 -134, Sale Of impounded
Animals And Disposition Of
Proceeds. The Poundmaster may
sell for cash, all animals so
authorized, as provided in the
preceding section, and out of the
proceeds of the sale thereof, pay his
proper fees and charges, and all
reasonable and proper demands
made under the provisions of this
code. Any balance of the proceeds
of a sale of any animal remaining
after the payment of such fees,
charges, and demands, shall be paid
into the general fund of the City.
Sec. 4- 137. Retaking Animals
Improperly. Released. The Pound -
master may retake any animal
directly or. indirectly conveyed or
delivered out of the pound without
lawful authority and again impound
and retain the same, and proceed as
heretofore provided in the same
manner as if said animal had never
been released from the pound.
Sectiork 4. Section 4 -735 of the
Alamedo Municipal Code is hereby
repealed.
Section 5. Sections 4 -224 and 4 -225 of
the Alameda Municipal Code are
amended to read:
Sec. 4 -224. Seizure And Disposition
Of Dogs On Public Grounds. Every
unleashed dog tound or tieing in or
upon the Alameda Municipal Golf
Course, or any. Park, Playground or
Recreation Center of. the City of
Alameda shall be taken into custody
by the Poundmaster or any Police
Officer and shall be transported to
and impounded in the Public Pound,
where, in addition to any other
fines, fees; charges, demands or
penalties provided in this Code, it
may be redeemed by the owner or
persons entitled to possession
thereof.
Sec. 4 -225. Right Of Any Person To
Seize Dog On Public Grounds. in
addition to the Poundmaster or any
Police Officer, any person may take

into his custody any unleashed dog,
found or being in or upon the
Alameda Municipal Golf Course, or
any Pork, Playground or Recrea-
tion Center of the City of Alameda,
and it shall be the duty of such per-
son to immediatelv.deliv.er such dog
to the Poundmoster who shall give
to such person a receipt for such
dog.
Section 6. Sections 9- 141,9- 144,9 -145,
9- 146, and 9 -147 are amended to read:
Seca 9 -141. Barking. And Howling
Dogs. It shall be unlawful in the City
of Alameda to harbor., keep or
maintain any dog or dogs which
disturb the peace and quiet of any
neighborhood or person. by persis-
tent or prolonged barking, howling
or making unusual.: noises. The
provisions of this section. .shall not
apply to premises operated as duly
licensed pet shops, wherein dogs
are temporarily kept and main-
tained for purposes of sale, but the
operators of: such pet shops shall
exercise appropriate means of
reducing the barking, howling and.
noise making of said dogs'
Sec. 9-144. Care Of Dogs During
Oestruation. No: person owning or
having possession of any female dog
shall suffer or permit the same to be
upon any public street of the City
during the period of oestruation of
said dog without being held or led
by a cord, chain or other thing not
over five feet in .Length and under
the supervision of a responsible
Person, or confined in a vehicle.
Sec. :9 -145. License Taxes ---
Amount. Every perso.n.who owns,
harbors or has in his possession or
control any dog over four months of
age in the City of Alameda shall pay
a license tax of Six Dollars ($6.00)
Per annum for each and every male
or female so owned, harbored,
controlled or possessed by him; and
no person shall own, keep, harbor
or possess any dog within the cor-
porate limits. of the City of Alameda
for which the license tax imposed
by this article has not been paid.
The license tax imposed by.this
section shall be paid and collected
in the manner and at the times
prescribed by ordinance for other
license taxes and shall be subiect to
the .conditions so prescribed for
such other license .taxes as far as
the some are applicable. An addi-
tional fee of Six Dollars ($6.00) shall
be charged if the above mentioned
license is not obtained within forty-
five (45) days after the date requir-
ing said license. A fee of fifty cents
shall be paid for each duplicate
license tog.
Sec. 9 -146. Seizure And Disposition
Of Untagged :And Unleashed: Dogs
--- Redemption. Every dog found or
being in any public street.of said
City and not being held or led by
cord, chain. or other thing, or con-
fined in any vehicle, shall be taken
by the Poundmoster to, and im-
pounded in the Public Pound, where
it may be redeemed by the owner or
Persons theretofore entitled to the
Possession of it within three (3)
days, excluding, Saturday, Sunday
and holidays, thereafter, on
Payment to the Poundmoster of Six
Dollars ($6.00), plus a feeding/ car -
Ing.charge as set forth in Section
2 -522 of the Code, and upon securing
a vaccination as required under this
Code:.
Sec. 9-147. Right Of Person To
Seize Dog Daring Oestruation. In
addition to the Poundmoster, any
person maytalce up any temaie dog
found or being in any public street
of said City during the period of
oestruation of said dog, and not be-
ing held or led by cord, chain, or
other thing not over. five feet (Y) in
length and under the supervision of
a responsible person, or confined in
any vehicle; and it shall be the duty
of such person to immediately
deliver such female .dog to the.
Poundmoster, who shall give to
such person a receipt for such
female dog.
Section 7. Section 9 -161 of : the
Alameda Municipal Cade is amended
to read:
Sec. 9.161. Keeping Swine. No
person in the City 'of Alameda shall
keep or permit to be kept on
premises owned, occupied or con-
trolled by him any swine, unless the
enclosure in which the same are
kept is at least three hundred feet
distant from premises owned.or oc-
cupied by anyother.person; and no
person shall keep at any place in
said City more than five head of
swine, unless the enclosure where
said swine. are kept is equal to one
acre.to each head of swine.
Section 8. Section 9 -171 of the
Alameda Municipal Code is amended
to read
Sec. 9 -171. Disposition. No person
shall deposit or place any dead
animal upon or in the ground, upon
the tidelands, in the waters of the
Bay of San Francisco, or any of its
estuaries within the City of
Alameda.
Section 9. The Alameda Municipal
Code is hereby amended by adding a
new Section 9 -116 thereto, to read:
Sec. 9 -116. Abandonment Of
Animal. It shall be unlawful for any
owner, keeper,.ar person having
possession or control, of any dog or
cat wilfully to abandon such animal
within the City.
Section 10. This ordinance shall be in
full force and effect from and after the
expiration of thirty (30) days from the
date of its findl passage.
