AN INTERIM ORDINANCE ENACTING A TEMPORARY MORATORIUM
ON THE APPROVAL OF TENTATIVE
SUBDIVISION MAPS FOR THE CONVERSION OF - MULTIPLE
DWELLINGS TO CONDOMINIUM
UNITS
THE COUNCIL OF THE CITY OF ALAMEDA
that:
Section 1. From and after the effec-
tive date of this ordinance, there shall
be no approval of tentative subdivision
maps for the conversion of multiple
dwellings to condominium units.
Section 2. For the purpose of this or-
dinance ''multiple dwelling unit" is
defined as a building or portion thereof
designed, intended or used to house, or
for occupancy by, three or more
families living independently of each
other.
Section 3. This ordinance is one of
great necessity and urgency within the
meaning of Section 3 -12 of the City
Charter and Section 65858 of the
California Government Code, is in-
troduced and passed at the same
Council meeting, and shall become ef-
fective on November 6, 1974.
Section 4. The facts constituting the
necessity and urgency hereof are:
A. The City of Alameda is
currently undertaking a study of,
and considering a revision of, the
regulations relating to the
approval of subdivision maps for
the conversion of multiple
dwellings to condominium units.
Said study may include, among
other issues, a study of the
following:
1) Possible taxation of con-
dominium conversions for
revenue purposes.
2) The extent to which current
building codes should be
applicable to condominium con-
versions.
3) The extent to which current
zoning regulations should be
applicable to condominium con-
versions.
4) The parking requirements
that should be applicable to
condominium conversions.
5) The effect of a conversion of
a multiple dwelling to con -
dominium units on the existing
tenants in the multiple dwelling
and the need for protection of
the interests of such tenants.
6) The extent of need for pro-
tection of the interests of pros-
pective purchasers of con-
dominium units.
7) The effect of a con-
dominium conversion on the
existing rental housing stock and
the need for protection of that
rental housing stock.
8) The effect of condominium
conversions on the individual
ownership housing stock of the
City.
9) The possibility of problems
in insuring future maintenance
of commonly owned areas in
condominiums.
10)Methods for securing
payment of taxes on commonly
owned areas of condominiums.
B. The purpose of this ordinance is to
provide a reasonable period of time for
such study, and for implementation of
the recommendations of any such
study, and in order to prevent the frus-
tration of the results of such study by
the approval of subdivision maps for
condominium conversions which may
be in conflict with the regulations
which may ultimately be adopted by
the Council,
Section 5. This Council hereby finds,
determines and declares that it is in the
best public interest and necessity that
this ordinance be introduced and
passed at the regular meeting of the
City Council held November 5, 1974,
and that this ordinance become and be
in full force and effect on November 6,
1974.
Section 6. This ordinance shall be
repealed and be of no further force and
effect four (4) months from the date of
adoption thereof; provided however,
that after notice pursuant to Section
65856 and public hearing, the legisla-
tive body may extend such interim or-
dinance for eight (8) months and sub-
sequently extend such interim or-
dinance for one (1) year.
