AMENDING THE ALAMEDA
MUNICIPAL CODE BY AMENDING
SUBSECTION (d) OF SECTION 3-1412
RELATING TO DEFINITION OF
"TRANSIENT" IN THE UNIFORM
TRANSIENT OCCUPANCY TAX OR-
DINANCE OF THE CITY OF
ALAMEDA
BE IT ORDAINED BY THE COUNCIL OFTHE CITY OF ALAMEDA:
Section 1. That the Alameda
Municipal Code is hereby amended by
amending subsection (it) of Section
3-1412 thereof, to read as follows:
(d) Transient. "Transient''
means any Person who exercises
occupancy or is entitled to oc-
cuponcv by reason of concession,
permit, right of access, license or
other agreement for a Period of
thirty-one (31) consecutive
calendar days or less, counting
Portions of calendar days as full
days. Any such Person so occupy-
ing space in a hotel shall be
deemed to be a transient until the
period of thirty-one (31) days has
expired unless there is an
agreement in writing between the
operator and the occupant
Providing for a longer Period of
occupancy. In determining
whether a Person is a transient,
uninterrupted periods of time ex-
fending both Prior and subsequent
to the effective date of this or-
dinance may be considered.
Section 2. This ordinance shall be ef-
fective thirty (30) days from and after
the date of its final passage.
