Ordinance 1861CITY OF ALAMEDA ORDINANCE NO. 1861, New Series AUTHORIZING EXECUTION OF AN ANNEXATION AGREEMENT BETWEEN THE CITY OF ALAMEDA AND THE CITY OF OAKLAND, ACTING BY AND THROUGH ITS BOARD OF PORT COMMISSIONERS AREAS, an exchange of properties between the City of Alameda and the Port of Oakland and an alteration of the boundaries of the City of Alameda and the City of Oakland would facilitate the construction of a city line road in Alameda and place Port owned and operated properties within the City of Oakland, as further set out in the recitals to the agreement approved herein; and WHEREAS, a certain form of agreement containing the pro- visions to be agreed upon by and between the City of Alameda and the City of Oakland, acting by and through its Board of Port Commissioners, in connection with the transfer, detachment and annexation of certain real property has been prepared and sub- mitted to this Council at its regular meeting held March 15, 1977, and placed in the office of the City Clerk, marked "Filed, March 15, 1977." NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that: Section 1 . The form of agreement referred to herein and the agreements and provisions thereof be, and the same are hereby, approved. -1- Section 2 . The Mayor of the City of Alameda is hereby authorized and directed to execute, and the City Clerk to attest, as the act and deed of the City of Alameda, an agreement sub- stantially in the form and containing the agreements and provisions set forth in the aforesaid form of agreement. Section 3 . This ordinance is one of great necessity and urgency within the meaning of Section 3--12 of the City Charter, is introduced and passed at the same Council meeting and shall become effective on April 6, 1977. Section 4 . The facts constituting the necessity and urgency hereof are: 1. The transfer of properties and annexations are re- quired for the control by the City of those lands necessary for the construction of City Line Road. 2. Control is required for application for federal funds. Such an application is already on file. 3. Delays in this matter could result in additional expenses or loss of grants. 4. The Council hereby finds, determines and declares that it is in the best public interest and necessity that this ordinance be introduced and passed at the regular meeting of c a the City Council held April 5, 1977 and that this ordinance become and be in full force and effect on April 6, 1977.
