AMENDING ORDINANCE NO. 1082 N.S. BY AMENDING
SECTION 14 THEREOF RELATING TO THE PENSION SYSTEM
OF MEMBERS OF THE POLICE AND FIRE DEPARTMENTS OF
THE CITY OF ALAMEDA ENTERING CITY SERVICE AFTER
JANUARY 1, 1953
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that:
Section 1 . Section 14 of Ordinance Nq. 1082 N.S. is
hereby amended to read as follows:
Section 14 Optional Modification of Pension
Until the first payment on account of any pension (whether
service or disability) is made, the member may elect to
receive in lieu of the unmodified allowance the actuarial
equivalent of his pension at the time of his retirement
as a lesser pension payable throughout his life, with
one of the following options:
(a) If he dies before he receives in pension payments
the amount of his accumulated contributions as it stood
at his retirement, the balance of such accumulated con-
tributions shall be paid to his beneficiary.
(b) Upon his death, his lesser pension shall be con-
tinued throughout the life of, or until remarriage of, and
paid to his surviving spouse, provided she was his wife at
least one (1) year prior to his retirement. In case of the
death of the widow, the City agrees to continue to distri-
bute the lesser pension herein provided for among the minor
children of the member until they either marry or reach
age 21, whichever occurs first.
Section 2 . This ordinance is one of great necessity and
urgency within the meaning of Section 3 -12 of the City Charter, is
introduced and passed at the same Council meeting, and shall become
effective
Section 3 . The facts constituting the necessity and
urgency thereof are:
1. The City Council adopted amendments to Ordinance
No. 1082 N.S. on December 7, 1976.
2. Those amendments will be effective on January 1, 1977.
3. Before any further amendments can be made persons will
retire under Ordinance No. 1082 N.S.
4. This amendment to Ordinance No. 1082 N.S. should be
made prior to those retirements.
Section 4 . The Council hereby finds, determines and declares
