AMENDING THE ALAMEDA MUNICIPAL CODE BY AMENDING SECTION
11 -14E5 THEREOF RELATING TO ADULT ENTERTAINMENT ACTIVITY
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that:
Section 1 . Section 11 -14E5 of the Alameda Municipal Code
is hereby amended to read as follows:
Sec. 11 -14E5 Discontinuance of Nonconforming
Adult Entertainment Activity within one year after the
effective date of this Article, all nonconforming adult
book stores, adult motion picture theaters, peep shows,
massage parlors and cabarets shall be discontinued or made
to conform, except that such activities may continue for
up to an additional two years upon the granting of a
conditional use permit pursuant to Article 6 of this
Chapter, except that the Planning Board must find, in
lieu of the requirements of Section 11 -162, that the use,
if continued, would not create a public nuisance and that
the activity is either obligated by written lease of the
premises exceeding one year of the effective date of this
Article, or that the activity involves investment of money
in leasehold or other improvements such that a longer
period is necessary to prevent undue financial hardship.
Section 2 . This ordinance shall be in full force and

effect from and after the expiration of thirty (30) days from

in regular meeting assembled on the 3rd day of May, 1977, by the following

Corica, (4).
NOES: None.
ABSENT: Councilman Sherratt, (1).
