AN ORDINANCE ADOPTING BY REFERENCE THE UNIFORM BUILDING
CODE, 1976 EDITION, COPYRIGHT 1976 BY THE INTERNATIONAL
CONFERENCE OF BUILDING OFFICIALS WITH AMENDMENTS,
ADDITIONS AND DELETIONS THEREOF AS THE PRIMARY CODE,
APPENDIX: CHAP'T'ER 13, 35, 49 AND 57 THEREOF, AND UNIFORM
BUILDING CODE STANDARDS, EACH REFERRED TO IN SAID PRIMARY
CODE AS THE SEC=ARY CODE; REGULATING THE ERECTION,
CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING,
REMOVAL,CONVERSION, DEMOLITION, OCCUPANCY, EQUIPMENT, USE,
HEIGHT, AREA AND MAINTENANCE OF BUILDINGS OR STRUCTURES
IN THE CITY OF ALAMEDA; PROVIDING FOR THE ISSUANCE OF
PERMITS AND COLLECTION OF FEES THEREFOR; DECLARING AND
ESTABLISHING A FIRE DISTRICT; PROVIDING PENALTIES FOR
VIOLATION THEREOF, AND REPEALING ORDINANCE NO. 1730 NEW
SERIES, AND ALL OTHER ORDINANCES IN CONFLICT THEREWITH
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that:
Section 1 Title. Uniform Building Code This Ordinance
shall be known as the "Alameda Building Code," may be cited as
such, and will be referred to herein as "this Ordinance" or "this
Code," or "Building Code."
The Uniform Building Code, as the Primary Code, and
Appendix, Chapter 13, 35, 49 and 57, and Uniform Building Code
Standards as the Secondary Code, Copyright 1976 by International
Conference of Building Officials, copies of which have been
placed on file with the City Clerk for use and examination by
the public and by Resolution No. 8697 declared to be public
records, as said copies have been deleted, changed and supple-
mented with the approval of this Council, and each and all of
the regulations, provisions, conditions, requirements and terms
thereof are hereby adopted as the Alameda Building Code for
regulating the erection, construction,_enla clement, alteration,
repair, roving, removal, demolition, conversion, occupancy,

equipment, use, height, area, and maintenance of all buildings
and structures in the City of Alameda, and by this reference are
incorporated herein and made a part hereof to the same effect as
though set forth herein in full.
Section 2 . General Standards All materials and assem-
blies of materials; appliances and installation of appliances;
arrangements of occupancies; all exits, aisles, stairs, doors and
appurtenances thereto in buildings or structures shall be so
arranged, assembled and of such size and so protected as to hold
to a minimum all exit, fire and health hazards.
The quality of all materials, method of connecting or
assembling such materials, stresses allowed and live and dead
loads assumed in the design and construction of all buildings or
structures shall be in accord with nationally recognized standards
of quality and with generally recognized and well established
methods of structural design and construction.
Compliance with all the provisions of the Alameda Building
Code referred to and adopted by the provisions of Section 1 here-
of shall be and is hereby declared to be prima facie evidence of
the reduction of fire and exit hazards, acceptable quality of
materials and generally recognized and well established methods
of construction and structural design.
Section 3 Chancres, Additions and Deletions. The changes,
additions and deletions of said Uniform Building Code, placed on
file with the City Clerk, hereinafter set forth and designated
are hereby approved and adopted as follows:
Section 101 is changed to read as follows:
" Sec. 101 This Ordinance shall be known as t`ic:

be referred to herein as 'this ordinance' or'this Code,'
or 'Building Code.'
"The Uniform Building Code, Copyright 1976, by

have been deleted, changed and supplemented with approval
of this Council, and each and all of the regulations,
provisions, conditions, requirements and terms thereof
are hereby adopted as the Alameda Building Code for
regulating the erection, construction, enlargement,
alteration, repair, moving, removal, demolition, con-
version, occupancy, equipment, use, height, area, and
maintenance of all buildings and structures in the City
of Alameda, and by this reference are incorporated herein
and made a part hereof to the same effect as though set
forth herein in full."
The following paragraph is added to Section 303(a) to
read as follows:
"Permit fee for demolishing buildings or structures
shall be $10.00 for each permit."
"Permit fee for reroofing shall be $10.00 for
each permit."
The following paragraph is added to Section 303 (b) to
read as follows:

"Plan- checking fee shall be $15.00 for identical
buildings as in a subdivision or tract. This is applicable
only when each building is to be constructed from identical
plans and specifications as approved for the original
structure."
Section 4 . Whenever in said Building Code the words
"City ", "Building Inspector ", "Fire Marshal ", "Building Official"
or other designation of an officer, board or department occur, the
word "City" shall mean the City of Alameda and the word "Building
Inspector ", "Fire Marshal ", "Building Official" or other designation
of an officer, board or department, shall mean respectively the
Building Inspector, the Fire Chief, or such officer, board or
department of the City of Alameda.
Section 5. validity If any section, subsection, sentence,
clause or phrase of said Building Code or of this Ordinance is for
any reason held to be unconstitutional, such decision shall not
affect the validity of the remaining portions of said Code or of
this Ordinance. The City Council hereby declares chat it would
have passed this Ordinance and each section, subsection, clause or
phrase thereof irrespective of the fact that any one or more
sections, subsections, sentences, clauses and phrases be declared
unconstitutional.
Section 6 . Penalties It shall be unlawful for any
person, firm, or corporation to erect, construct, enlarge, alter
repair, move, improve, remove, convert or demolish, equip, use
occupy or maintain any building or structure in the City, or
cause or permit the same to be done, contrary to or in violation
of any providions of this Code.

Any person, firm or corporation violating any of the
provisions of this Code shall be deemed guilty of a misdemeanor,
and each person shall be deemed guilty of a separate offense for
each and every day or portion thereof during which any violation
of any of the provisions of this Code is committed, continued, or
permitted, and upon conviction of any such violation such person
shall be punished by a fine of not more than THREE HUNDRED
DOLLARS ($300.00) or by imprisonment for not more than NINETY
(90) days, or by both such fine and imprisonment.
Section 7 . That Ordinance No. 1730 New Series, of the
City of Alameda, passed September 17, 1974 and effective
October 18, 1974 and all other ordinances and parts of ordinances
of the City of Alameda in conflict herewith be, and the same are,
hereby repealed.
Section 8 . This Ordinance shall be in full force and

City of Alameda in regular meeting assembled on the 19th day of July, 1977,
by the following vote, to wit:

NOES: None.
ABSENT: Councilmen Beckam and Tillman, (2).
