Ordinance 1885CITY OF ALAMEDA ORDINANCE NO. 1885 New Series AMENDING CERTAIN PORTIONS OF THE ALAMEDA MUNICIPAL CODE RELATING TO TRAFFIC REGULATIONS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that: Section 1 . Section 17 -3311, entitled "Parking in Designated Turn -out Areas," is hereby added to Article 3 of Chapter 3, Title XVII of the Alameda Municipal Code, to read: Sec. 17 -3311 Parking in Designated Turn -out Areas It shall be unlawful for any person to stop, park, or leave standing, any vehicle unattended in any turn -out area (such unauthorized vehicles will be removed) per local ordinance except as listed below: 1. When necessary to avoid injury or damage to persons or property. 2. When required by law or in obedience to a peace officer. 3. When actually engaged in maintenance or construc- tion work within the public right -of -way on roadway property, or when any employee of a public agency is actually engaged in the performance of official duties. 4. When automotive or other equipment is needed in maintenance or construction work within the public right - of -way. 5. When any vehicle is disabled and it is not feasible to avoid temporarily stopping or any vehicle which has been -1- summoned to render assistance to a vehicle or person includ- ing a vehicle owned by the donor or free emergency assistance but such parked or stopped vehicle shall not remain in the turn -out for a period in excess of four hours. 6. When any person is in process of reporting a traffic collision or other situation or incident to a peace officer or any person specified in subdivision (3) either directly or by means of any emergency telephone or similar device. 7. When the owner or operator of a tow car operating under an agreement with the City of Alameda for the purpose of rapid removal of impediments to traffic. Restrictive parking in designated turn -out areas shall be in effect at the following locations: (a) Island Drive, on both sides thereof, and left -turn pockets from the southerly line of Doolittle Drive to the northerly line of Mecartney Road. (b) Mecartney Road, on the north side thereof, and left -turn pockets from the westerly line of Island Drive to the westerly line of Fontana Drive. Section 2 . Section 17 -333 (All Time and Limited No Parking) of the Alameda Municipal Code is hereby amended by amending sub- section (13) thereof to read as follows: (13) Island Drive, on both side thereof, from the southerly line of Doolittle Drive to the northerly line of Mecartney Road with the exception of turn -out areas designated for maintenance and emergency vehicles. Section 3. Section 17 -333 of the Alameda Municipal Code is hereby amended by adding subsection (79) thereto to read as follows: (79) Mecartney Road, on the north side thereof, from the westerly line of Island Drive to the westerly line of Fontana Drive extended with the exception of turn -out areas designated for maintenance and emergency vehicles. Section 4 . Section 17 -344.1 (24- Minute Parking Limit) of the Alameda Municipal Code is hereby amended by repealing subsection 9(a) thereof. Section 5 . This ordinance is one of great necessity and urgency within the meaning of Section 3 -12 of the City Charter, is introduced and passed at the same Council meeting and shall become effective on October 5, 1977. Section 6 . The facts constituting the necessity and urgency hereof are: 1. That traffic regulations are essential for the orderly flow and control of traffic within the City. 2. That such regulations should necessarily be immedi- ately effective on passage to insure that maximum preservation of public welfare is obtained. 3. That a potential health and safety problem will exist if such amendments are not immediately effective. -3- 4. That, in light of such potential health and safety problems involved, the normal delay between enactment of this ordinance and its effective date would be injurious. 5.
