Ordinance 1886CITY OF ALAMEDA ORDINANCE NO. 1886 New Series AUTHORIZING SALE OF CERTAIN CITY -OWNED REAL PROPERTY TO MARIO DeLUCCHI AND ERMA DeLUCCHI (2417 CENTRAL AVENUE, FORMER U.S. POST OFFICE PROPERTY) WHEREAS, the City of Alameda is the owner of the herein- after described real property, which is no longer required for municipal purposes, and it is in the best public interest to dispose of same; and WHEREAS, Mario DeLucchi and Erma DeLucchi, by written proposal, offered to purchase said real property for the sum of $191,770.77; and WHEREAS, by Resolution No. 8733 adopted June 7, 1977, this Council accepted the offer of Mario and Erma DeLucchi; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that: Section 1 . The City of Alameda convey, by quitclaim deed, unto Mario DeLucchi and Erma DeLucchi, all that certain real property situated in the City of Alameda, County of Alameda, State of California, more particularly described as follows: COMMENCING at the point of intersection of the northeasterly line of Central Avenue (as said avenue now exists since being widened to eighty (80) feet) with the northwesterly line of Park Avenue (formerly Pine Street) running thence northerly along said northwesterly line of Park Avenue one hundred and forty (140) feet, thence at right angles westerly one hundred and forty (140) feet, thence at right angles southerly one hundred and fifty four (154) and -1 45/100 feet to the said northeasterly line of Central Avenue and thence easterly along said northeasterly line of Central Avenue one hundred and forty and 73/100 feet to the point of beginning. SUBJECT TO rights of way, restrictions, reservations, and easements now existing or of record. TOGETHER WITH all and singular the tenements, hereditaments and appurtenances thereunto belonging, or in anywise appertaining, and the reversion and reversions, remainder and remainders, rents, issues, and profits thereof, and also all the estate, right, title, interest, property possession, claim, and demand whatsoever, in law as well as in equity, of the said GRANTOR of, in or to the foregoing described premises, and every part and parcel thereof, with the appurtenances, for and in consideration of the sum of one Hundred Ninety -one Thousand, Seven Hundred Seventy and 77/100 Dollars ($191,770.77) to be paid in cash to the City of Alameda by said Mario DeLucchi and Erma DeLucchi coincident with the tender of a quitclaim deed conveying said property. Escrow, title insurance and other charges, if any, shall be paid by said purchaser. Section 2 . The Mayor of the City of Alameda is hereby authorized to execute, and the City Clerk to attest to, on behalf of the City, a quitclaim deed conveying the hereinabove described property to said Mario DeLucchi and Erma DeLucchi. Section 3 . This ordinance is one of great necessity and urgency within the meaning of Section 3 -12 of the City Charter, is introduced and passed at the same Council meeting, and shall become effective on October 5, 1977. -2- Section 4 . The facts constituting the necessity and urgency hereof are: (1) It is necessary for the County of Alameda to begin its lease of a portion of the above named property on January 1, 1978. (2) That the lease cannot become effective until the close of escrow and attendant financing is completed. (3) That said escrow and attendant financing period cannot commence until the effective date of an ordinance. (4) That Section 3 -12 normally requires that an ordinance become effective 30 days after passage. Such a delay would have an adverse effect on the sale and lease arrangements. (5) That no circumstances not planned for would arise from advancing the closing date and it would be in the interest of the City to advance said closing date. o (6) This Council hereby finds, determines and declares z that it is in the best public interest and necessity that this r ordinance be introduced and passed at the regular meeting of the City Council held October 4, 1977, and that this ordinance become and be in full force and effect October 5, 1977. n. d Presiding Officer of the Council Attest: r' Deputy City Clerk -3- I, the undersigned, hereby certify that the foregoing Ordinance was duly and regularly introduced and passed by the Council of the City of Alameda in regular meeting assembled on the 4th day of October, 1977 by the following vote, to wit: AYES: Councilmen Beckam, Sherratt, Tillman and Vice President Diament, (4).
